[22/09, 14:06] Sekarreporter: The Supreme Court, comprising Honourable Mr Justice Surya Kanth and Mr Justice Koteeswaran Singh, ordered notice today in the transfer petition filed by the State of Tamil Nadu. In its transfer petition, the State sought the withdrawal of a writ petition pending before the Madras High Court to the Supreme Court, as a substantial question of law is involved. One Venkatachalapathi Kutty filed a writ petition challenging the 10th Amendment Acts relating to universities in TN, which came into force through an order of the Supreme Court deemed “assent”. The writ petition was moved during court vacation, and the division bench, comprising Honourable Mr Justice G.R. Swaminathan, granted a stay of one provision of the Amended Act relating to the power of appointment of the Vice Chancellor by the State government. It is to be noted that the State had already challenged the said order of stay before the Supreme Court, which has already issued notice in the SLP filed by the State against this interim order.
