ORDER

The writ petition is filed by the auction purchaser for a direction to consider the representation dated 21.04.2026 and to initiate regulatory action including suspension/withholding of affiliation, approval, counselling participation and admissions in respect of the Educational
Institutions run by respondents 14 to 17.

It is the case of the petitioner that the Bank/secured creditor had initiated proceedings under the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, (SARFAESI Act) as against respondents 14 to 17/borrowers. The petitioner had participated in the auction and has been declared as the successful bidder, pursuant to which, a sale certificate has been executed. It is the further case of the petitioner that respondents 14 to 17 are continuing to run the Educational Institutions and if approval is granted for admitting the students, the interest of petitioner would be prejudiced. In this regard, the petitioner had submitted a representation on 21.04.2026, which has not been acted upon. Thus, the petitioner is before this Court.

Learned Senior Counsel for the petitioner submitted that though the petitioner was declared as the successful bidder and even on payment of the entire sale consideration, the rights of the petitioner have been frustrated by the borrower, who had lost interest in the property after the sale had concluded. He further submitted that since the application filed by the petitioner to implead themselves as a party before the Debts Recovery Tribunal (DRT) is kept pending without adjudication, the petitioner was left with no other alternative except to approach this Court.

Countering these submissions, learned Senior Counsel appearing for respondents 14 to 17 submitted that since the sale notice and the order passed under Section 14 of SARFAESI Act has been challenged before the DRT in separate proceedings, which are pending, the relief sought for by the petitioner in this writ petition may not be maintainable and thus, the same is liable to be dismissed.
5. We have given our anxious consideration to the submissions made by the respective counsel and perused the materials available on record.
6. It is not in dispute that respondents 14 to 17 are borrowers, who have availed financial assistance from the Bank. In view of the default in repayment of dues, SARFAESI proceedings were invoked. A demand notice under Section 13(2) was issued on 30.12.2017 followed by a possession notice under Section 13(4) dated 04.04.2019. Pursuant to the proceedings initiated, the Bank had issued sale notice dated 30.06.2025 bringing the property for auction on 16.07.2025. The auction had taken place and a sale certificate has also been executed in favour of the petitioner/successful bidder on 23.07.2025, on payment of the entire sale amount of Rs.45.60 Crores. However, the borrower had challenged the sale notice before the DRT in S.A.No.515 of 2025 as well as the order passed under Section 14 in S.A.No.493 of 2025. The DRT has granted an order of interim stay in S.A.No.493 of 2025, thereby staying the further proceedings of the order passed under Section 14. Admittedly, both the appeals are said to be pending.

When the borrower has challenged the sale notice and the order passed under Section 14 before the DRT in S.A.No.515 and 493 of 2025 respectively, wherein an application has been filed by the petitioner to implead them as a party respondent, it would only be open to the petitioner to redress their grievances before the DRT in the pending appeals.
8. In view of the aforesaid deliberations, we are of the considered opinion that the petitioner and respondents 14 to 17 can only agitate all their grievances in the appeals pending before the DRT. The petitioner is also at liberty to file an appropriate application praying for early hearing of the appeals as well as the impleading application before the DRT.
9. With the above observations, the writ petition is disposed of. There shall be no order as to costs. Consequently, connected
miscellaneous petition is closed.
