The Petitioner Thiru S Saranya had alleged that there was no Criminal offense made out in the subject FIR & complaint, and the entire facts are civil in nature. The petitioner had also pointed out that the respondent police had connived with the complainant Gokulraj to give criminal color to the civil dispute which was clear from the fact that some male police officers came along with the defacto complainant to the residence of the petitioner, and at around 1 am in the middle of the night, all the hardware belonging to her were handed over to the de-facto complainant without any legal documentation such as magazar or panchnama. The court, while observing that, the petitioner had made out the prima facie case for an interim order and restrained the police from filing Final Report in the case.
