  1. A third person has independent of interest in immovable property of another or any easement thereon, a right to restrain enjoyment, for more beneficial enjoyment of his own property

  4. Transfer made by person fraudulently or erroneously to be authorised and transfer for consideration, such transfer shall at option of transferee operate on any interest acquired later by transferor during subsistence of contract
