இந்நிலையில், பாமகவின் பெயர், கொடி மற்றும் சின்னத்தை பயன்படுத்த அன்புமணிக்கு தடை விதிக்கக்கோரியும், கட்சியின் தலைவராக தம்மை அறிவிக்கக்கோரியும் ராமதாஸ் சார்பில் சென்னை உரிமையியல் நீதிமன்றத்தில் மனுத்தாக்கல் செய்யப்பட்டது.
இந்த வழக்கை விசாரித்த
உரிமையியல் நீதிமன்றம் மற்றும் சென்னை உயர்நீதிமன்றம் ஆகியவை ராமதாஸ் தொடர்ந்த இடைக்கால மனுக்களை தள்ளுபடி செய்தது.
இந்த நிலையில் பாமக நிறுவனர் டாக்டர் ராமதாஸ் சென்னை 13வது உரிமையியல் நீதிமன்றத்தில் தொடர்ந்துள்ள புதிய வழக்கில், அன்புமணி ராமதாஸ் கட்சியில் இருந்து நீக்கப்பட்டவர் என்றும் தனக்கும் அன்புமணி ராமதாஸுக்கும் எந்த தொடர்பும் இல்லை என்றும் பாமக தலைவராக சட்ட விரோதமாக அன்புமணி ராமதாஸ் நீடித்துவருவதாக தெரிவித்துள்ளார். தேர்தல் பிரச்சாரத்தில் தன்னுடைய புகைப்படத்தை அன்புமணி தரப்பு வேட்பாளர்கள் 18 பேரும் பயன்படுத்தக்கூடாது என தடை விதிக்க வேண்டும் என கேட்டுக் கொண்டிருந்தார். இந்த வழக்கு நீதிபதி தர்ம பிரபு முன்பு விசாரணை வந்தது. வழக்கை விசாரித்து நீதிபதி இதுகுறித்து

Crux of the Issue & Jurisdiction

It is submitted that the objectionable flex boards, hoardings, banners consisting of the photographs, portraits and images of the plaintiff are being displayed throughout the Constituencies where the 4th to 21st defendants concerned are contesting and the office of the 2nd defendant comes within the jurisdiction of this Hon’ble court. Moreover, all the election related activities, meetings and the mode of campaign including the instructions given to the 5th to 21st defendants are taking place at the residence of the 4th Defendant which has come within the jurisdiction of this Hon’ble Court. Further, the damages claimed by the Plaintiff is at a sum of Rs.50,00,000/- which comes within the pecuniary jurisdiction of this Hon’ble Court, hence the plaint is filed before this Hon’ble Court.
Fame And Good Will of the Plaintiff:
4. It is submitted that the Plaintiff is concerned; no doubt, he is one of the unique personalities in our Country. Besides, for decades, he has been leading his life in all respects in such a manner that is “better to unique than the best, because being the best makes you number one, but being unique makes you the only one”. The plaintiff having such a leadership has been leading lakhs and lakhs of his followers throughout the State.
5. It is further submitted that the quote referred above will squarely applicable to the intellectual personality of the Plaintiff, since it is necessary to recollect the past events. Moreover, these facts are constrained to be recorded here to sensitize the younger generation and others those who have forgotten and failed to recall and recollect the vigor and vibrant activities of the plaintiff from the day of inception of the below mentioned political party till to-day.
6. It is submitted that the plaintiff being a Physician registered with the Medical Council, commenced his professional career. However, as his vision had not been confined by himself with his professional career only,
as a man who has been Championing Social Justice, he wanted to cultivate the ideologies of the renowned personalities Dr. Ambedkar, E.V.Ramasamy and other revolutionary personalities among the down trodden in the whole State. With these genuine object, he established the renowned political party on 16.07.1989 namely Pattali Makkal Katchi. The said party was duly registered with the Election Commission of India under the Representation of Peoples Act, 1951 and introduced the flag of the party with the meaningful vision.

It is submitted that pursuant to the successful registration of the political party as a Founder the plaintiff sculptured the discipline of the party and reached the heart of the downtrodden by his incomparable and tiresome service rendered to the Society. To make everyone knows the vibrant principles and ideologies of the plaintiff and the party, he used to travel across the State and Country to meet lakhs and lakhs of people and has propagated the aforesaid ideologies through which he has earned their trust. As the plaintiff is one of their Samaritans, lakhs of people started to follow him and his ideologies with complete trust. This has culminated into the successful election of thousands of people’s representatives from the political party up to the Parliament, the State Assembly and other local bodies.
8. It is submitted that with a perspective view by considering the relentless and tiresome attitude of the Plaintiff, one of the by-laws that is Rule 13 of the party was incorporated the domain of the Plaintiff as Founder over the political parties as follows;

Dedication and Devotion of the Plaintiff towards the Political Party:

It is submitted that apart from the facts stated above, the Plaintiff has dedicated his whole life, with complete devotion; his intellectual diplomacy has been giving contribution to the party and thereby creating several leaders throughout the Country. However, as a “Man of Principles” he has not assumed any office of the Elected Representatives
through the political arena. This would demonstrate the persistence of the Plaintiff in the relentless service to the downtrodden with complete dedication though his political and social career.
9. It is submitted that the facts stated above are only sum and substances, pith and marrow of the career of the Plaintiff and they are only a tip of iceberg. However, as the facts are being so, in the recent past, so many abrupt things have happened in the political party among the office bearers. At the same time, as those are put under challenge by the parties concerned and appropriate legal proceedings were initiated, disposed of and some of them are pending before the forums competent, the Plaintiff has decided not to delve into those aspects in this notice. So, the Plaintiff makes it clear that he has reserved all his legal rights over the other disputes with regard to the core issue of the political party. On the other hand, without prejudice his legal rights in connection with the core issue
of the political party, the Plaintiff has taken the instant cause for his redressal, since his Fundamental Right To Privacy is being willfully and intentionally infringed by the defendants nos.3 to 21.
10. It is submitted that though an Original Suit in O.S.No.664 of 2026 on the file of XIIIth Assistant City Civil Court Chennai, which has no direct nexus with the cause of action of the present suit.
Compelling necessity for the Plaintiff to file the suit:
11. It is submitted that the above said acts of the defendants nos.3 to 21intiff is under the compelling necessity to file the instant original suit to protect his Fundamental Right to Privacy categorically protected under Article 21 of the Constitution as an intrinsic part of the right to life and personal liberty is intentionally being infringed by the Defendants concerned. It is not merely a statutory right, but a core human right guaranteed under Part III of the Constitution., on the other hand, the same is being violated with malice by affixing, displaying and portraying the photographs and images of the Plaintiff at various poses as a part of the election campaign of the defendants nos.5th to the 21st on the instigation of the 3rd and 4th defendants and thereby passing a wrong message as if the Plaintiff is part of the political party under which the aforesaid Defendants are contesting the Assembly Election, as on to-day. The following tabular column would show the contesting constituencies of the individual respondent respectively.

12. It is further submitted that as on to-day, the Plaintiff is banished from the political party. On the other hand, throughout their Constituencies, in all kinds of media, the photographs and images of the Plaintiff is being displayed and exhibited for the political gains of the defendant nos.3 to21. However, all these acts are nothing but malicious being carried on without the consent of the Plaintiff by the aforesaid defendants.

It is submitted that the Plaintiff being a Founder, as on to-day, he is not within the party, but at the same time, the Fame of the Plaintiff is being harvested for the political gains of the defendant nos.3 to 21. Being a living person, the Plaintiff has Unique Identity in the Country and having protection of his Right to Privacy. In fact, Rule of Law is bedrock of our Constitution, it would apposite to say that without getting concurrence
from the plaintiff, no one is entitled to use his photograph in any form in any media including the social, digital medias and all kinds of telecasting medias.
14. It is further submitted that Right to Privacy is an independent right as guaranteed under the Constitution without any ambiguity. So, the photographs of the Plaintiff being displayed in various platforms without his consent for the personal and political gains of the defendant nos.3 to 21 are not only condemnable, but the same is an offence under the relevant provisions of various laws. However, for the usage of the same, the defendants mentioned herein are jointly liable to pay damages to the tune of several crores of rupees, but the Plaintiff has confined the claim of damages to the tune of Rs.50,00,000/-(Rupees Fifty Lakhs only).
15. It is submitted that for instances the flex boards, banners and other kinds of displays are herein annexed in the list of documents of the plaint, which are collected throughout the State. Apart from that using the photographs of the Plaintiff is amounting to misappropriation of his right, with deliberate intention, as guaranteed under Constitution of India.
16. It is submitted that since the oral instructions to the Defendants concerned have not fetched good things, the Plaintiff was constrained to send a legal notice dated 08.04.2026 and 09.04.2026 to all the defendants to stop their illegalities and to stop the same immediately dated 08.04.2026 and 09.04.2026. Since acts of the defendant nos.3 to 21 is not only illegal, but would amount to an act of intrusion of the Fundamental and Civil Rights of the Plaintiff. However, on 09.04.2026, the defendants nos. 1 and 2 being competent authorities of the Election Commission of India are also put on notice, since Model Code of Conduct (MCC) is in force in view of forth coming General Election, 2026 for the State Legislative Assembly, to initiate legal action against the erred. So, viewing from any angle, the using of photos and images of the Plaintiff as referred above is not only illegal and unauthorized, but the same would be an invasion upon the Reputation, Fame and Goodwill of the Plaintiff.
17. It is submitted that the defendants nos. 3 to 21 have been using the photographs of the Plaintiff in the ongoing State Legislative Assembly Election campaign, 2026 without his permission or consent in almost all the places of their constituencies almost in all the conspicuous places of Wards of Greater Chennai Corporation. It has come to knowledge of the Plaintiff that the Plaintiff’s photograph is being displayed in the Flex boards, banners posters, bit notices and pamphlets within jurisdiction of the constituency where the defendants nos. 4 to 21 are contesting at the instance of the 3rd and 4th Defendants. Such unauthorized use of the photograph of the Plaintiff is illegal, misuse of identity and is causing serious harm to the Plaintiff’s reputation. Hence, the contesting candidates are to be restrained from using the photographs, portraits and images of the Plaintiff and they are to be directed to remove all the posters, flex banners, bit notice, wall paintings and pamphlets containing the photographs of the Plaintiff. Failing which, the official defendants are to be directed to initiate legal action against the erred defendants in accordance with law with immediate effect.

It is submitted that the plaintiff has lodged complained to initiate legal action to the defendant no’s: 1 and 2 and the concerned District Collectors where the 4th to 21 are contesting respectively as their acts are totally illegal and in fact they are liable for legal action, but no legal action is initiated. Further, the defendants nos. 4 to 21 have used the fame and goodwill of the plaintiff in the ongoing election campaign under various platform are liable to pay damages to the plaintiff to the tune of Rs. 50,00,000/-, even though the fame of the plaintiff cannot be valued in terms of money.
19. It is submitted that as the date election is scheduled on 23.04.2026, in the prevailing circumstances, the plaintiff is constrained to file the instant suit to get the protection to protect his Fundamental Right to Privacy. Otherwise, the individual Defendants would continue their illegalities in the name of election campaign.
20. The Plaintiff has not filed any other suit for the same relief before any court.
CAUSE OF ACTION
The Cause of action arose on 28.05.2022 when the 3rd defendant claimed and declared himself as President of Pattali Makkal Katchi, in the subsequent days whenever disputes have arisen in the political party among the plaintiff, the 3rd and 4th defendants, on 06.02.2026 when the Original Suit in O.S.No.664/2026 was filed by the plaintiff, on 07.03.2026 when a petition was filed in O.S.No.664/2026 by the 3rd defendant for the relief of rejection of plaint, in the subsequent days that is immediately after announcement of General Election, 2026 for Tamil Nadu State Assembly and the 3rd and 4th defendants along with individual defendants joined together and thereby started to use the photographs and portraits and images of the plaintiff in all kinds of medias including the electronic medias followed by the announcement of State Assembly Election by the 1st and 2nd defendants, especially in several places of Chennai City and other districts of the State of Tamil Nadu as part of their election campaign.
COURT FEES:-
I) It is submitted that the plaintiff has valued the 1st relief of the suit at a sum of Rs.50,00,000/- for which court fees a sum of Rs.1,50,000/- is paid herewith U/s.22 of Tamil Nadu Court Fees and Suits Valuation Act, 1955.
II) The 2nd relief of the suit, it is valued at a sum of Rs.1000/- for which court fees a sum of Rs.30/- paid herewith U/s. 27(c) of Tamil Nadu Court Fees and Suits Valuation Act, 1955 for the purpose of jurisdiction.
III) The 3rd relief of the suit, it is valued at a sum of Rs.1000/- for which court fees a sum of Rs.30/- paid herewith U/s. 27(c) of Tamil Nadu Court Fees and Suits Valuation Act, 1955 for the purpose of jurisdiction.
Therefore, it is prayed that this Hon’ble Court may be pleased to pass a preliminary judgment and decree in favour of the plaintiff by:
a) Passing a Permanent Injunction thereby restraining the defendants nos. 3 to 21 and any person claiming through them from in any way and in any manner using the photographs, portraits and all kinds of images of the plaintiff in any Social, Printing and Electronic medias throughout the State of Tamil Nadu and especially in all parts of the Chennai City;
b) Directing the individual defendants nos. 3 to 21 to jointly pay a sum of Rs.50,00,000/- as damages to the Plaintiff by way of Mandatory Injunction;
c) mandatory Injunction Directing to the defendants No 3 to 21 to remove photographs of the plaintiff in all the flex board, wall painting, sign boards and hoarding and all other Social, Printing and Electronic medias throughout the State of Tamil Nadu and especially in all parts of the Chennai City;
d) By directing the defendants nos.3 to 21to pays the costs of the suit to the Plaintiff.
e) To pass such further or other reliefs as this Hon’ble Court may deem fit and proper in the circumstances of this case and thus render justice.
