Thirumoorthy for Counsel for R1 The Commissioner of Rasipuram Municipality challenged the order dated 02.09.2024 passed by Justice G.K. Ilanthiraiyan, directing the Municipality to execute sale deeds in favour of retired municipal employees K. Suburayan, M. Athiayappan, and A. Ramabai for the quarters allotted to them, after fixing the present market value as the sale consideration within eight weeks. The employees relied upon the Government of India, Ministry of Housing letter dated 23.07.1957, which envisaged that houses constructed by public institutions on a no-profit, no-loss basis should ultimately be sold or allotted to their employees. The writ appeal came up for hearing on 03.08.2026 before the Bench comprising Chief Justice Sushrut Arvind Dharmadhikari and Justice G. Arul Murugan. On behalf of the employee-respondents, Advocate R. Thirumoorthy appeared in supporting the Single Judge’s order. The Division Bench dismissed the writ appeal, thereby confirming the direction to execute the sale deeds in favour of the retired employees in accordance with the order dated 02.09.2024.
