1. The Petitioner humbly submits that on 18.04.2024 the first respondent police have registered the impugned First Information Report in Crime No.83 of 2024 for the alleged offences punishable under Section 188 of the Indian Penal Code read with Section 126(2) of the Representation of the People Act, 1951, on the basis of a complaint preferred by the second respondent, who was functioning as the Head of Flying Squad Team–3 (Regular) in connection with the Parliamentary General Elections, 2024.
2. The Petitioner further submits that the case of prosecution is as follows:
a) It is alleged that while the second respondent was discharging his duty on 18.04.2024, information was received at about 3.30 p.m. from the Office of the Assistant Returning Officer regarding a complaint received through the cVIGIL portal by one. Mr.Rajesh
b) It is further alleged that the petitioner, who was the Indian National Congress candidate for the Virudhunagar Parliamentary Constituency, had carried out election campaigning through his Facebook page during the silence period between 10.00 a.m. and 11.00 a.m. on 18.04.2024, thereby violating the provisions of Section 126(2) of the Representation of the People Act, 1951.

c) Based on the cVIGIL information, the de-fcato complainant has lodged the complaint before the 1st respondent requesting to initiate appropriate legal action against the petitioner, pursuant to which the impugned First Information Report came to be registered by the first respondent police.
GROUNDS
1. The Petitioner respectfully submits that the registration of the impugned First Information Report under Section 188 of the Indian Penal Code is ex facie illegal. In view of the statutory bar contained under Section 195(1)(a)(i) of the Code of Criminal Procedure, 1973, no prosecution for an offence punishable under Section 188 IPC can be initiated except upon a complaint in writing by the public servant concerned before the jurisdictional Magistrate. The impugned FIR is therefore liable to be quashed.

2. The Petitioner further submits that the issue is no longer res integra.
In Jeevanandham and others v. State represented by the Inspector of Police, reported in 2018-2-L.W. (Crl.) 606 : 2018 SCC OnLine Mad 13698, this Hon’ble Court categorically held that a Police Officer cannot register an FIR for offences falling under Sections 172 to 188 IPC and that prosecution can be initiated only upon a written complaint by the public servant concerned before the jurisdictional Magistrate in terms of Section 195(1)(a)(i) of the Code of Criminal Procedure, 1973. The impugned FIR, having been registered in complete disregard of the aforesaid binding principles, is therefore liable to be quashed.

3. The Petitioner further submits that the offence under Section 126(2) of the Representation of the People Act, 1951 is a non-cognizable offence falling under Part II of Schedule I of the CrPC. Under Section 155(2) of CrPC, the police cannot investigate such an offence without obtaining a prior order from the jurisdictional Magistrate as held by this Hon’ble court in Gokulakrishnan @ Subash vs The State in Crl.O.P.No.2707 of 2021. In the present case, the first respondent admittedly registered the impugned FIR and commenced investigation without obtaining such order. Consequently, the FIR and the entire investigation are vitiated and liable to be quashed.

4. The Petitioner further submits that the mandatory procedure governing a non-cognizable offence cannot be circumvented by mechanically invoking Section 188 IPC. Once the invocation of Section 188 IPC is itself unsustainable, the investigation into the alleged offence under Section 126(2) of the Representation of the People Act, 1951, without the requisite order of the Magistrate, is equally illegal. Hence, it is liable to be quashed.

5. The Petitioner further submits that the continuance of the impugned criminal proceedings, despite the statutory violations set out hereinabove, would amount to an abuse of the process of law. Therefore, the petitioner approaches this Hon’ble Court to exercise its inherent jurisdiction under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, to secure the ends of justice by quashing the impugned FIR.

6. The petitioner craves leave of this Hon’ble Court to raise additional grounds at the time of hearing, if necessary.

b) It is further alleged that the petitioner, who was the Indian National Congress candidate for the Virudhunagar Parliamentary Constituency, had carried out election campaigning through his Facebook page during the silence period at about 11.30 a.m. on 19.04.2024, thereby violating the provisions of Section 126(2) of the Representation of the People Act, 1951.

7. Brief Facts The brief facts of the case is that the second respondent was discharging his duty on
19.04.2024, information was received at about 5.45 p.m. from the Office of the Assistant Election Officer regarding a complaint received through the cVIGIL portal by one Mr. Selvakumar
It is further alleged that the petitioner, who was the Indian National Congress candidate for the Virudhunagar Parliamentary Constituency, had carried out election campaigning through his Facebook page during the silence period at about 11.30 a.m. on 19.04.2024, thereby violating the provisions of Section 126(2) of the Representation of the People Act, 1951.
Based on the cVIGIL information, the de-fcato complainant has lodged the complaint before the 1st respondent requesting to initiate appropriate legal action against the petitioner, pursuant to
which the impugned First Information Report came to be registered by the first respondent police.
