PRAYER:-Writ Petition filed under Article 226 of the Constitution of India, praying for an issuance of Writ of Mandamus, directing the 1st respondent to take stringent action against the respondents 4 to 6 as per the law and restore the fundamental rights of the petitioners in their village and prevent the human rights violation as per the representation of the petitioner dated 30.07.2023.

ORDER

This writ petition has been filed seeking to direct the 1st respondent to take stringent action against the respondents 4 to 6 as per the law and restore the fundamental rights of the petitioners in their village and prevent the human rights violation as per the representation of the petitioner dated 30.07.2023.

2.Learned counsel for the petitioner would submit that the petitioner owns a land in Survey No.435/2A,  situated at Pillankuppan Village, Krishnagiri Taluk. The 4th respondent who possess the land adjacent to the petitioner’s land demanded pathway to access his land for the past several years. Since the petitioner denied to provide her land to the 4th respondent to utilise as pathway, the 4th respondent brought the issue before the Katta Panchayat leaders, who are the respondents 5 and 6 herein. The respondents 5 and 6 had passed an illegal orders as narrated hereunder:-

“a).The petitioner and his family have to be ostracized from 24.02.2022 and this was announced by thandora all over the village.

b). The petitioner is not allowed to take water from the public water sources. No groceries allowed to purchase from the local shops and not allowed at tea shops.

c). They curtailed the petitioner’s worship rights also.

d).Villagers are prohibited from participating in the

family functions of petitioner.

e). If the petitioner and her family violates the above decision they have to pay one Lakh rupee as fine to Khap Phanchayath / Katta panchayath / Panchayath.

f). If other public and shop keepers violates the above

decision they have to pay Rs 25,000/- as fine.”

Therefore, the petitioner made a representation dated 30.07.2023 before the respondents 1 to 3 requesting to take action against the respondents 4 to 6.

However, till date no action has been taken by the respondents 1 to 3. Hence, the present writ petition has been filed.

3.Learned Additional Government Pleader appearing for the 1st respondent and the learned Government Advocate appearing for the respondents 2 and 3 would submit that the Regional Divisional Officer conducted enquiry in this regard and found that no such action has been done as alleged by the petitioner.

4.In reply learned counsel for the petitioner would submit even now the same situation prevails against the petitioner in the village, which requires to be followed by the respondents 1 to 3.

5.Heard the learned counsel for the petitioner; learned Additional

Government Pleader appearing for the 1st respondent and the learned Government Advocate appearing for the respondents 2 and 3.

6.Considering the submissions made by either parties, the respondents 1 and 2 is directed to conduct enquiry independently in this regard and ensure that no injustice is caused to the petitioner by violating her fundamental rights as contemplated under Article 21 of the Constitution of India. The aforesaid exercise shall be completed within a period of twelve (12) weeks from the date of receipt of a copy of this order. In the event, the official respondents found any illegality committed by the respondents 4 to 6 as alleged by the petitioner, immediately the official respondents shall take legal action, including filing an FIR against the respondents 4 to 6.

7.With the above direction, this writ petition is disposed of. No costs.
