Justice Swaminathan says, his Bench intends to pass orders on the HCP on Friday. He asks whether Mr. Arun wants to say something. Mr. Arun says, the detainee (a realtor) had been accused of forging signatures of the complainant. Justice Swaminathan says, the question is whether the invocation of the Goondas Act is justified. The judge says the court has also been following the track record of Mr. Arun in invoking preventive detention law. Mhc Full bench/ There is a valid distinction between ‘resignation’ and ‘voluntary retirement’ as held by the Three Judge Bench of the Hon’ble Supreme Court inSenior Divisional Manager LIC and Ors vs Shree Lal Meena[10]. Therefore, resignation from service cannot be treated as voluntary retirement. The principle settled in D.Vijayarangan Vs. Secretary Sales Tax Appellate Tribunal and Others (supra) is held to be bad in law. Therefore, the views of the division Bench of this Court in A.I.Angel Illangovan Vs. The Government of Tamil Nadu (supra), is hereby upheld.
