CHENNAI: Madras high court on Tuesday refused to restrain costume designer Joy Crizildaa from using the hashtag Madhampatty Thangavelu Hospitality Pvt Ltd and its brand Madhampatty Pakashala in her social media posts.

This was in connection with her personal dispute with celebrity chef T Rangaraj, one of the directors of the company.
Justice N Senthilkumar passed the order while rejecting the plea moved by Madhampatty Thangavelu Hospitality Private Limited. The company alleged a revenue loss of Rs 12.5 crore due to the tagging of the company in the issue. While the company insisted on a gag order against Crizildaa, claiming that the issue doesn’t have any public interest to deny such an order, the designer claimed that she did not utter even a word against the company or its commercial activities but was fighting only for the interest of her unborn child.
The company claimed that the ‘madhampattypakshala’ hashtag, which was included in the caption of her Instagram post on July 26 and subsequent posts, amounted to infringement and disparagement of their trademark. Opposing the plea, the designer contended that there are certain essentials to attract disparagement. Therefore, in this present case, just tagging ‘madhampattypakshala’ in social media posts will not amount to disparagement.

She further questioned the veracity of the losses suffered by the company, as there was not sufficient proof or materials to support the same. The clients may have cancelled the contracts due to unsatisfactory taste, service, or other reasons best known to them, which may have been completely unrelated to the hashtags, she said.
