ORDER
(Order of the Court was made by M.S.Ramesh, J.)
According to the learned Advocate General, as per paragraph 4 of our earlier order dated 10.10.2025, the Institute of Valuers have deputed about 109 valuers in 23 Districts and the process of evaluating the properties is ongoing. He would also submit that during the course of coming weeks, they would depute similar valuers for the other remaining 10 Districts also.
2.We are of the view that since the properties of Kalaimagal Sabha is spread over 33 Districts, we intend to bring the properties, without encroachment, for auction, as the first step. It would be desirable that the exercise of auctioning of these properties can be commenced with two Districts as a test measure, followed by the auction for the remaining Districts.
3.With this intention in mind, when we had suggested to the learned Advocate General that the Districts of Coimbatore and Tiruvarur would be ideal Districts, since there is
about 141.85 acres in Coimbatore, without encroachment, the learned Advocate General submitted that there are 4 valuers at present and they would explore the possibility of deputing more valuers to Coimbatore District. It was also pointed out to us that insofar as Tiruvarur District is concerned, there is only one property measuring an extent of 4.24 acres, which is free from encumbrance and stands in the name of Kalaimagal Sabha.
4.Hence, the Committee is called upon to depute the sufficient valuers for valuation of the properties in these two Districts and submit a report by next hearing.
5.Mr.Ravi Kumar, learned Government Pleader (Puducherry) has produced a copy of the field verification reports. As per the said reports, among the properties found in serial numbers upto 37 therein except one property in Sl.No.16, third party interest have been recorded in all other properties.
6.The learned Government Pleader (Puducherry) is called upon to submit a tabular column of all the survey numbers in the Union Territory of Puducherry, together with respective measurement of the lands, in the next hearing.
7.Insofar as the State of Tamil Nadu is concerned, the Inspector General of Registration has already instructed the 155 Sub Registrars in the State, to record the properties of Kalaimagal Sabha as “prohibited properties”, which direction has already been carried out. Likewise, in our earlier order dated 10.10.2025, we had directed the Principal District Judges to instruct all the Civil Courts to refrain from entertaining any
civil suits by any person against the property belonging to Kalaimagal Sabha. A similar exercise could also be carried out in the Union Territory of Puducherry.
Accordingly, the following directions are issued:-
(a) The Inspector General of Registration, Puducherry, is called upon to instruct all the
Sub Registrars in the Union Territory of Puducherry, to record all the properties of Kalaimagal Sabha as “protected properties”. Any attempt to create any sort of encumbrance shall be brought to the notice of this Court forthwith, by the Inspector General of Registration.
(b) The Chief Judge, Puducherry is called upon to instruct all the Civil Courts under its jurisdiction, to refrain from entertaining any civil suits, by any person, against the property belonging to Kalaimagal Sabha, morefully described under the schedule, unless leave of this Court is obtained. Such a communication shall be made after the learned Government Pleader (Puducherry) produces the tabular column of the details of the properties of Kalaimagal Sabha, as mentioned above in this order.
