Record Kalaimagal Sabha properties as ‘protected’: HC

Chennai: Madras high court directed the inspector general of registration in Puducherry to instruct all sub-registrars in the Union territory to record all properties of Kalaimagal Sabha as ‘protected properties’ to safeguard the interests of investors.

“Any attempt to create any sort of encumbrance shall be brought to the notice of high court. The Chief Judge, Puducherry, is also directed to instruct all the civil courts under its jurisdiction to refrain from entertaining any civil suits by any person against the properties belonging to Kalaimagal Sabha,” Justice M S Ramesh and Justice N Senthilkumar said.
Kalaimagal Sabha, a society based in Namakkal, launched a real estate scheme, collecting money from members with promise of land.
As the society failed to give land or repay members, cases were filed against the society founders, leading to a decade-long legal battle.

On Friday, advocate-general P S Raman submitted that as per an earlier court order, the Institute of Valuers deputed 109 valuers in 23 districts, and the process of evaluating the properties is ongoing. He said they would depute similar valuers for the remaining districts as well in the coming weeks.

The bench said, “We are of the view that since the properties of Kalaimagal Sabha are spread over 33 districts, we intend to bring the properties, without encroachment, for auction, as the first step…”
As for Tamil Nadu, the IG of registration has already instructed the 155 sub-registrars to record the properties of Kalaimagal Sabha as ‘prohibited properties’, the court said.
