This petition is coming on this day before me for hearing in the presence of M/s. S. Immanual, P. Thamizh Vendan, J.Gunasekaran, the counsel for the petitioner and of CPP for the respondent and upon hearing them, this Court delivered the following
ORDER
1. The petitioner, who was arrested on 03.09.2025 for the offences punishableunder Section 77 of BNS, Sec.66E of IT Act and Sec.4 of TNPHW Act in Crime No.6/2025 on the file of the respondent police, seeks bail.
2. Learned counsel for the petitioner submits that the petitioner is aged 70 years. The petitioner came to attend his case pending before the X Assistant City Civil Court, Chennai in E.P.No.1270/2013. He is innocent. He has not committed any offence. He has been falsely implicated in this case. The petitioner is suffering from various ailments. He has no bad antecedent. Already, petitioner’s mobile phone was seized by the respondent police and sent to Forensic Lab. Therefore, further incarceration of the petitioner is not necessary. The petitioner is in custody from
03.09.2025 and hence, prays for granting bail.

On the other hand, the learned CPP submits that this petitioner, who came tothe court to attend his case, took the photos of the defacto complainant, Advocates, Staff and other women in an inappropriate manner in the court campus and uploaded the same in the social media. Based on the complaint given by the defacto complainant, the case was registered and the petitioner was arrested. Petitioner’s mobile phone was seized and sent to Forensic Lab for analysis. Investigation is pending. Hence objects granting bail.

The allegations against the petitioner is that the petitioner took the photos ofthe defacto complainant and other women in an inappropriate manner in the court campus and uploaded the same in the social media. On the other hand, learned counsel for the petitioner submits that the petitioner is aged 70 years and he is suffering from various ailments and hence prays for granting bail. Considering the age of the petitioner and that no serious injury is caused, this court is inclined to grant bail to this petitioner.
5. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties, each for a likesum to the satisfaction of the learned III Metropolitan Magistrate, Chennai and on further condition that
(a) the sureties shall affix their photographs and Left Thumb impression inthe surety bond and the learned Magistrate may obtain a copy of their Aadhar Card or Bank Pass Book to ensure their identity.
(b) the petitioner shall appear before the respondent police daily at 10.00a.m.
until further orders.
(c) the petitioner shall not tamper with evidence or witness either during
investigation or trial.
(d) the petitioner shall not abscond either during investigation or trial.
(e) On breach of any of the aforesaid conditions, the learned Magistrate/TrialCourt is entitled to take appropriate action against the above petitioner in accordance with law as if the conditions have been imposed and the above petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon’ble Supreme Court in P.K. Shaji Vs. State of Kerala [(2005) AIR SCW 5560].
(f) If the petitioner thereafter absconds, a fresh FIR can be registered underSection 269 of BNS.
