- Madras HC declines Rs.10.22 crore earmarking for Punniyamoorthy; extends ‘Dhruva Natchathiram’ release deadline to July 31 CHENNAI: The Madras High Court has declined to direct that a sum of Rs.10.22 crore be earmarked or retained on behalf of K. Punniyamoorthy and K. Premkumar, while at the same time extending the deadline for the release of Gautham Vasudev Menon’s long-delayed Tamil film ‘Dhruva Natchathiram’ to July 31, 2026. Justice Senthilkumar Ramamoorthy passed the common order on June 30, 2026, disposing of three connected applications — Arb. Appln. Nos. 1244 and 1245 of 2026 and Application No. 2438 of 2026 — in O.A. No. 283 of 2023. ## The Rs.10.22 crore claim turned down Punniyamoorthy and Premkumar, the original applicants, had moved the court seeking a modification of its earlier order dated April 30, 2026, so as to include their claim of Rs.10.22 crore — said to be payable under a compromise decree dated April 3, 2018 in O.P. No. 932 of 2017 — in the list of payments to be made from the dedicated account maintained for the film. In the alternative, they asked that the advocate observers/overseers earmark and retain Rs.10.22 crore representing their claimed entitlement, and not disburse it without the court’s permission. The court did not accede to that relief. Instead of directing any earmarking, retention or deposit of the Rs.10.22 crore, Justice Ramamoorthy granted only a limited modification of the earlier order — directing the observers/overseers to examine the documents relating to loans and advances received from the creditors named in Gautham Vasudev Menon’s affidavit, so as to verify and confirm whether the amounts stated to be payable to them are genuinely due. The verification is to be completed within a maximum of 15 days, and debits from the account will be permitted only to the extent the amounts are found to be correct. Counsel for the original applicants had contended that the amounts said to be payable to Jaswant Bhandari, Vijay Kothari and M/s SPM Arts LLP in the April 27, 2026 affidavit were incorrect, and had handed over a chart to show that Vijay Kothari had not advanced any amount for the production. In the alternative, they had pressed for security to be furnished for their Rs.10.22 crore money claim — a request the court did not grant. The court also took up the application by respondents 2 to 4 seeking additional time to release the film. The April 30, 2026 order had directed release on or before June 15, 2026. Satisfied that sufficient cause had been shown, and that the movie could not be released by the earlier date despite best efforts, Justice Ramamoorthy extended the time limit for the release of ‘Dhruva Natchathiram’ up to July 31, 2026. The submissions on behalf of the respondents were made by two senior advocates. Mr. T.R. Rajagopalan, Senior Counsel, appearing for the fourth respondent (M/s Kondaduvom Entertainment), submitted that the original applicants could not re-argue O.A. No. 283 of 2023 in the guise of a modification application, and that no modification of the April 30, 2026 order was necessary. Mr. A. Abdul Hameed, Senior Counsel, appearing for the second and third respondents (Gautham Vasudev Menon and S. Venkataraman), had at the earlier hearing on June 25, 2026 sought time to obtain instructions on whether the observers could verify the amounts said to be payable to the creditors, and subsequently placed on record an affidavit affirmed on June 29, 2026 expressing no objection to the observers examining the documents produced in the sealed cover for the purpose of confirming the correctness of the claimed amounts. For the original applicants, Senior Advocate Mr. S.R. Rajagopal appeared, while Ms. Inthu Karunakaran appeared for the first respondent. Mr. M.V. Swaroop and Mr. H.S. Hredai appeared for the observers. With these directions, all three applications were disposed of.
