view of the fact that the rules of natural justice had been complied with in the present case and the charges were proved based on the evidences and documents, this Court do not find any perversity in the departmental disciplinary proceedings. Regarding quantum of punishment, the proved charges are grave in nature and therefore, there is no reason whatsoever to interfere with the quantum of punishment. The punishment cannot be construed as excessive or disproportionate. For all these reasons, the writ petition fails and stands dismissed. No costs. Item no 30, before Hon’ble Justice p t Asha Section 34 application was filed challenging an award. Based on the same award an execution proceeding was initiated before Kanchipuram Distrixt Court which was subsequently stayed by the High Court. Upon verification and contradictions with the Award copy, the Arbitrator was directed to be present before the Court. Also notice was issued by Justice Asha to the Bar council of Tamil Nadu directing them to verify enrolment details of the Arbitrator who passed out in 2013z The Arbitrator was present before the Court today and stated that this is a fraudulently obtained award and that he did not appear as a arbitrator at any point of time.
