  O.A. No. 1090 to 1092 in C.S.No 687/2019 Petition: Filed By K.Shobana( popularly know as ‘Mahanadi Shobana’) seeking to restrain M/s Symphony Recording from manufacturing, selling and distributing ‘Kanda Sasti Kavacham’ and another album. Harihara Arun Somasankar argued that there can be no rights claimed by ‘M/s Symphony Recording’ under Copyrights Act based on the agreement executed by a minor. Also section 19 of Copyrights Act restricts the rights under copyrights over and above 5 years If it’s executed for an unlimited period. The Hon’ble High Court of Madras has held that ‘When the defendant themselves claim their rights through two documents, which are prima facie illegal, any further act of the defendant in distributing, manufacturing or selling the songs of K. Shobana would be impermissible’. Hence interim injunction had been granted.
