[1/21, 14:44] Sekarreporter1: Central government criticises 7.5% reservation given to school students in Tamilnadu through a reservation Act terming it as “*dilution of merit by providing separate quota to govt students*”.
This stand was revealed through ASG Sankaranarayanan in the counter affidavit filed in the WP which came up for hearing before Hon’ble Mr Justice Pugalenthi.
The writ was filed by one Minor Subbulakshmi seeking for a writ of mandamus to approve the scheme of introduction 0f 10% horizontal reservations for student from government schools with in Union Territory of Puducherry for admissions to MBBS/ BDS.
The Pudhucherry Union cabinet headed by Mr Narayanaswamy approved 10% of reservation to the students studying in pondicherry schools and sent to Lt Governor Kiranbedi who inturn referred to the Central Government for approval of policy decision of Puducherry government on the context that she is differing with the views of Puducherry cabinet, on 6.11.2020. The counter filed by Home department of central government informed the court through counter affidavit that the Health department has objected to such 10% reservations and wanted 6 weeks time to decide on the reference made by the Lt Governor on this subject.
Since the dead line for admissions for MBBS and BDS is nearing, a student from Pudhucherry has filed the present WP to approve the scheme by Central Government .
Mr P. Wilson appearing for the Student / Writ petitioner took a strong exception to the counter filed by Central government and submitted that the Central government is belittling the 7.5% reservations adopted in TN. He submitted that when Bill were passed by TN Legislature, the governor of TN sent for opinion of Solicitor General of central government along with the TN 7.5% reservation bill and solicitor general gave his opinion that bill is in accordance with the constitution. He wondered as to how the Ministry of Health and family welfare of central government can find fault with 7.5% reservations Act of TN that it dilutes merit. He submitted that the stand of Central government is running against will of the people and the constitution and putting spokes to the decisions of Popularly elected government. He said since 2016 no students studied in govt schools got admission in government medical colleges in Puducherry and the admission rate is zero . The scheme will help government students to get admission in government medical college and lethargic attitude in delaying to take decision has doomed the dreams of the students this year. He said the Supreme Court itself has said that such reservations by state are permissible and therefore he prayed to issue Mandamus as prayed for.
The Learned judge recorded the objections and granted 4 weeks time for the central government to take a decision on the reference sent by Lt Governor and posted the case to 25.2.2021 for hearing the matter.
