It was for the first time in the history of Madras State Legislative Assembly the issue of Disqualification of M.L.A.s – X Schedule of the Constitution of India arose and the issue was brought before the Madras High Court by Late Adv V.Anantharaju in Writ Petition challenging the failure of Speaker to discharge his constitutional duties. WP came up for admission before Late Justice S. Mohan who patiently heard my pre and post argument for 2-1/2 hours with volley of question and answer by argument but in finality he disagreed with my contention to the failure of the speaker and gave a finding that the issue is premature and held that the situation has not arisen for the Court to declare the relief.

[4/15, 14:12] Rubt Three: Continuation X Schedule of Constitution of India case In Janaki & Jayalalitha power struggle Writ Petition was fled for declaring 4th Respondent as disqualified to be a member of the House in terms of paragraph No.2 of the Xth Schedule to the Constitution as he and others had abstained from voting and Speaker of the house should have ordered their disqualification in terms of Article 191(2) r/w Para 6 of Xth Schedule. The Speaker failed to discharge his duties as provided under the Constitution in Article 191(2) r/w para 2(1)(b) 3 and 6 of the Xth Schedule of the Constitution in so far as he had not disqualified 34 MLAs, he has created chaos in the administration of the Government of Tamil Nadu. Late Justice Mohan did not agree to the stand tamen in WP and held situation has not arisen for the Court to declare. Hence W.P. Dismissed as not maintainable. 31 years ago the MHC did not accept my view on Xth schedule but now SC has accepted it
