5-1-2021 Shivaji MHC advocate: whether Indian parliament is absolute sovereign power while compares to UK parliament? Indian parliament is not sovereign body. sovereign means: a state (here state means nation/country) possessed absolute, unlimited, uncontrollable power within it and it will not accept or get undue influence from any quarter to decide it’s internal and external obligations with others’ state.that is by virtue of existence of free state it is imbibed or encrypted with sovereign.( for example during British regime India is not a sovereign state because sovereign power lies with England queen which she assumed in 1858 by way of Queen proclamation ,such sovereign power was transferred to Indians in1947 as independence) . so in India all the Wings of government has only limited sovereign power, not absolute power. therefore Indian parliament doesn’t have absolute sovereign power/function like that of UK parliament. the constitution of India is permanently acting as limitations over parliament towards its business, because parliament is mere creature of constitution and the constitution is not created by parliament.so it’s legislative function is limited and it cannot make laws as they wishes or majority govt wishes or against the ideals of constitution of India……… but practically is it so in India? ……. thanks follows
