TR Ramesh, Petitioner, filed the said matter seeking a relief in the nature of Mandamus, against the Hr and Ce Department, for proactive disclosure of information specifically vide sections 4(1)(a)-(d)of the RTI Act, to upload all Government Orders, Tenders, etc taken by the Hr and Ce Department.

B. Jagannath, Appeared for Petitioner, Ravichandran appeared for Hr and Ce Department & Vigneswaran Chandrasekar appeared for State Information Commissioner.

During the course of arguments, it was pointed out as an Oral observation, by the Learned Single Judge that the information sought for by the Petitioner, doesn’t come under the Official Secrets Act & that the Respondents are duty bound to upload the same in their website in consonance with Section 4 of the RTI Act, as the same involves amount of the devotees.

Furthermore, the Respondents claim to be a vibrant department and are not providing the information sought for by the Petitioner, especially when it comes to the secular & financial aspects of the Respondent Department including Tenders and Government Orders. They should have uploaded the information in the website.

Learned Counsel for Respondents, AGP Hr and Ce, Ravichandran sought time to file counter.

Since both the Interim & Main prayers are the same, matter stands adjourned to 29.10 for Respondents to obtain instructions & file counter.
