Mr. P. Wilson, Senior Advocate appearing for DMK candidate pressed for amendment of the petition prayer to direct CBI investigation on a fresh complaint to be registered and to implead CBI as a party to the case. He argued that the only FIR in the case came to be quashed collusively by the Police and that the Police failed to bring to the attention of the Single Judge quashing the FIR the pendency of cases before the Division Bench. Further, the state government’s officers were defying the orders of the election commission to file an appeal against the order quashing the FIR. The ECI itself has come out and said the Chief electoral officer is not abiding by it’s direction to file an appeal against the order quashing FIR
The ld. AG appearing for the Inspector of Police opposed the prayer.
The Court has reserved orders.
