[03/08, 17:38] sekarreporter1: *TIRUPARANKUNDRAM DEEPAM CASE – SUPREME COURT DECLINES TO STAY MADRAS HIGH COURT JUDGMENT*

The dispute concerning the lighting of Karthigai Deepam at the Deepathoon situated atop the Tiruparankundram Hill came up before the Supreme Court today.

The Division Bench of the Madras High Court, Madurai Bench, had recognised the right to light the Deepam at the Deepathoon, while making the exercise of such right subject to certain conditions.

Questioning the imposition of such conditions and the qualified nature of the right recognised by the Division Bench, Rama Ravikumar filed a Special Leave Petition before the Supreme Court. The Tamil Nadu Hindu Religious and Charitable Endowments Department also filed a separate Special Leave Petition challenging the very same judgment.

Both Special Leave Petitions came up for admission today before a Bench comprising Hon’ble Mr. Justice Aravind Kumar and Hon’ble Mr. Justice Vipul M. Pancholi.

Senior Advocate Mr. P. Valliappan appeared and argued on behalf of Rama Ravikumar. Senior Advocate Mr. Jaideep Gupta appeared and argued on behalf of the Hindu Religious and Charitable Endowments Department.

After hearing the parties, the Supreme Court issued notice in both Special Leave Petitions and directed the respective respondents to file their counter affidavits.

Significantly, the Supreme Court declined to grant any interim stay of the judgment of the Division Bench of the Madras High Court.

The Supreme Court further directed that both Special Leave Petitions be tagged with W.P.(C) No. 1280 of 2025, which is already pending before the Court.

Thus, as on date, there is no interim stay of the Division Bench judgment recognising the right to light the Deepam at the Deepathoon.
[03/08, 17:38] sekarreporter1: *திருப்பரங்குன்றம் தீபம் வழக்கு – உயர்நீதிமன்ற உத்தரவுக்கு இடைக்காலத் தடை விதிக்க உச்சநீதிமன்றம் மறுப்பு*

திருப்பரங்குன்றம் மலை உச்சியில் உள்ள தீபத்தூணில் கார்த்திகை தீபம் ஏற்றுவது தொடர்பான வழக்கில், சென்னை உயர்நீதிமன்ற மதுரைக் கிளையின் இரு நீதிபதிகள் அமர்வு, தீபம் ஏற்றுவதற்கான உரிமையை அங்கீகரித்து, அதனை சில நிபந்தனைகளுக்கு உட்படுத்தி தீர்ப்பளித்திருந்தது.
அவ்வாறு தீபம் ஏற்றுவதற்கான உரிமை நிபந்தனைகளுக்கு உட்படுத்தப்பட்டதை எதிர்த்து ராம ரவிக்குமார் சார்பில் உச்சநீதிமன்றத்தில் சிறப்பு அனுமதி மனு (SLP) தாக்கல் செய்யப்பட்டது. அதே உயர்நீதிமன்றத் தீர்ப்பை எதிர்த்து தமிழ்நாடு இந்து சமய அறநிலையத் துறையும் தனியாக சிறப்பு அனுமதி மனு தாக்கல் செய்திருந்தது.

இவ்விரு சிறப்பு அனுமதி மனுக்களும் இன்று உச்சநீதிமன்றத்தில் மாண்புமிகு நீதிபதிகள் அரவிந்த் குமார் மற்றும் விபுல் எம். பஞ்சோலி ஆகியோர் அடங்கிய அமர்வு முன்பு விசாரணைக்கு வந்தன.

ராம ரவிக்குமார் சார்பில் மூத்த வழக்கறிஞர் திரு. பி. வள்ளியப்பன் ஆஜராகி வாதிட்டார். இந்து சமய அறநிலையத் துறை சார்பில் மூத்த வழக்கறிஞர் திரு. ஜெய்தீப் குப்தா ஆஜராகி வாதிட்டார்.

வாதங்களைக் கேட்ட உச்சநீதிமன்றம், இரு சிறப்பு அனுமதி மனுக்களிலும் நோட்டீஸ் பிறப்பித்து, சம்பந்தப்பட்ட எதிர்தரப்பினர் பதில் மனுக்களைத் தாக்கல் செய்ய உத்தரவிட்டது.

மேலும், சென்னை உயர்நீதிமன்ற மதுரைக் கிளையின் இரு நீதிபதிகள் அமர்வு பிறப்பித்த தீர்ப்பிற்கு இடைக்காலத் தடை விதிக்க வேண்டும் என்ற கோரிக்கையை உச்சநீதிமன்றம் ஏற்க மறுத்தது.

அத்துடன், இவ்விரு சிறப்பு அனுமதி மனுக்களையும் ஏற்கனவே உச்சநீதிமன்றத்தில் நிலுவையில் உள்ள W.P.(C) No.1280 of 2025 உடன் இணைத்துப் பட்டியலிடவும் (tag) உத்தரவிடப்பட்டது.

எனவே, திருப்பரங்குன்றம் தீபம் தொடர்பாக சென்னை உயர்நீதிமன்ற மதுரைக் கிளையின் இரு நீதிபதிகள் அமர்வு வழங்கிய தீர்ப்பிற்கு உச்சநீதிமன்றம் எந்த இடைக்காலத் தடையும் விதிக்கவில்லை என்பது குறிப்பிடத்தக்கது.
