O R D E R
This Writ Petition has been filed seeking the issuance of a Writ of Mandamus forbearing the third respondent and their subordinates from interfering in any manner with the day-to-day lawful scientific waste disposal activities and permit for the continuous scientific disposal of waste carried out at the Ramayanpatti Dump Yard by the petitioner Companys Integrated Rendering Plant situated at S.F.No.11/1, 11/2, Megamudaiyarkulam Village, Tirunelveli Taluk, Tirunelveli District – 627 358.
2. According to the petitioner company, it is a company incorporated
under the provisions of the Companies Act. It is submitted that the third respondent Municipality has been facing acute difficulty in the scientific disposal of meat waste, including chicken, fish and other biodegradable animal waste generated within its municipal limits. Taking note of the public health and environmental concerns, the Municipal Council, by Resolution No.160 dated 28.10.2022, recorded that, out of nearly 200 metric tonnes of solid waste generated every day, about 10 metric tonnes comprised highly putrescible meat waste. Since the Municipality was unable to process such waste on its own, it resolved to establish an Integrated Rendering Plant for scientific disposal of the waste through the Public-Private Partnership (PPP) mode. Pursuant thereto, the third respondent issued a Notice Inviting Expression of Interest dated 17.10.2022 for establishing an Integrated Rendering Plant at the Ramayanpatti Dump Yard. The petitioner emerged as the successful bidder and thereafter, a tender agreement was executed with the third respondent. A work order dated 22.03.2023 was issued in favour of the petitioner, and the project site was formally inspected by the Municipal Administration on 15.02.2023.
3. It is further submitted that the petitioner has obtained all the
requisite statutory clearances, including consent under Section 21 of the Air
(Prevention and Control of Pollution) Act, 1981 and Section 25 of the Water
(Prevention and Control of Pollution) Act, 1974 from the Tamil Nadu Pollution Control Board. The consent granted by the Pollution Control Board is valid up to 31.03.2027. The concession agreement is for a period of ten years, during which the petitioner is obligated to scientifically process the meat waste generated by the third respondent Municipality.
4. The grievance of the petitioner is that, whenever objections are
raised by certain anti-social elements or local residents, the third respondent Municipality and the District Administration frequently interfere with the functioning of the plant and direct stoppage of the operations. Such interference seriously affects the petitioner’s contractual obligations under the tender conditions and may expose the petitioner to further litigation. It is further submitted that interruption of the waste management process would also result in accumulation of putrescible waste, causing foul smell, environmental pollution and public health hazards. The learned counsel would therefore submit that the petitioner is not seeking immunity from lawful inspection by the statutory authorities. However, unnecessary interference with the day-to-day functioning of the plant, contrary to the tender conditions, deserves to be restrained.
Accordingly, he prayed for appropriate directions.
5. Pursuant to the direction of this Court dated 03.07.2026, on
instructions, the learned counsel appearing for the third respondent submitted a status report before this Court.
6. Considering the submissions made and the report placed before
this Court, this Court is of the view that the disputes, if any, between the petitioner and the local residents shall be resolved by the official respondents in a peaceful manner, so as to enable the petitioner to perform its obligations stipulated under the tender conditions. The petitioner is permitted to continue operating the Integrated Rendering Plant situated at the Ramayanpatti Dump Yard, subject to compliance with all statutory requirements and the conditions imposed by the Tamil Nadu Pollution Control Board. The third respondent Municipality is directed to ensure uninterrupted supply of meat waste generated within its municipal limits to the petitioner’s plant in terms of the concession agreement. The petitioner, in turn, shall receive and process only the waste generated by the third respondent Municipality and shall not collect or process meat waste from any other local body without obtaining the necessary permission under law. The official respondents are at liberty to conduct inspections in accordance with law, however, such inspections shall not unnecessarily interfere with the smooth functioning of the petitioner’s operations or the implementation of the concession agreement.
7. The writ petition stands disposed of with the above directions. No
costs.
