O R D E R
1. Leave granted.
2. Heard learned Counsel for the parties.
3. This appeal arises from an order dated 27.06.2025 passed by the High Court of Judicature at Madras rejecting the anticipatory bail prayer of the appellant in connection with FIR No. 101/2025.
4. After considering the submissions of the learned Counsel for the appellant, on 30.06.2025, following order was passed :
“1. Learned counsel for the petitioner submits that there is no dispute that the abductee was recovered and not from the possession or control of the applicant. The applicant has been implicated for mala fide reasons by alleging that he had a hand in the abduction. It has also been contended that even assuming that the applicant interacted with one of the parties to the dispute, that may be considered for the purposes of settling the issue. It has next been contended that in any event no custodial interrogation is required. 2. The matter requires consideration. Issue notice.
3. In the meantime, if the petitioner is arrested in connection with FIR No.101/2025 registered at PS – Thiruvalangadu (renumbered as C.R. No.1/2025), he shall be released on personal bond of Rs.25,000/-, subject to the undertaking that he shall cooperate in the investigation and will not threaten the witnesses or tamper the evidence.”
5. We have heard learned Counsel for the Respondent-State.
6. We do not find a good reason to discharge the interim order. Consequently, we deem it appropriate to dispose of this appeal by making the interim order absolute subject to the following two conditions:
(A) The appellant shall co-operate in the investigation and make himself available for interrogation as and when required by the investigating agency; and
(B) Within three weeks from today, he shall submit bail bonds to the satisfaction of the Trial Court concerned along with an undertaking that he shall not threaten the witnesses or tamper the evidence.
7. The appeal is disposed of in the above terms.
8. Pending application(s), if any, shall stand disposed of.
