Madurai: Madras high court has directed officials to continue paying monthly pension to an elderly woman from Theni district saying the reasons cited in the order to stop the pension are not sustainable.

Petitioner Lakshmi, 80, who lives separately from her two sons and daughter was sanctioned monthly pension by the special tahsildar for social security scheme under the Indira Gandhi National old age pension scheme at Andipatti on March 13, 2012. However, it was withdrawn suddenly from October 2013. Since there was no response to her petitions, she moved HC Madurai bench in 2019 following which the court directed the officials to consider her representation and pass orders on merit. Thereafter, the special tahsildar passed an order dated July 30, 2019, stopping monthly pension to the petitioner. Lakshmi moved the court again this year seeking to quash the order. Justice Pushpa Sathyanarayana observed that the rejection order passed by the officials stated that the petitioner is the owner of two acres of land and has two sons. The order also says that the sons who are 62 and 58 years have no jobs and the land has been partitioned among the two. The petitioner is also hearing impaired and unable to do any work by herself. The judge noted that the special government pleader submitted that they are willing to continue paying pension of Rs 1,000 considering the petitioner’s age. The judge observed that there is no reason for withdrawal of the monthly pension from October 2013 and the officials are dutybound to pay the arrears to the petitioner. Though the special government pleader submitted that it would be difficult to heed the request as it will lead to many petitions claiming arrears, she submitted that arrears would be paid to the petitioner for 2019 by treating it as a special case. With the petitioner’s counsel also agreeing, the judge directed payment of Rs 12,000 arrears to the petitioner for 2019 in four weeks.


The special tahsildar was also asked to pay monthly pension of Rs 1,000 from January 2020 throughout her lifetime.
