[24/07, 15:59] Mohandas: Plea Seeks Prospective Implementation of BCI Resolution; Raises Concerns Over Post-Election Change in Bar Council Composition

A Chennai based BJP Advocate A. Mohandoss, practicing before the Madras High Court and the Supreme Court of India, has submitted a detailed representation to the High-Powered Election Supervisory Committee of the Bar Council of India, the High-Powered Committee for the Bar Council of Tamil Nadu & Puducherry Election-2026, the Returning Officer, the Bar Council of India, and the Bar Council of Tamil Nadu & Puducherry.

The representation challenges the proposed implementation of the Bar Council of India communication dated 21 July 2026, issued pursuant to the General Council Meeting held on 19 July 2026, which proposes increasing the effective elected strength of State Bar Councils to facilitate 30% reservation for women advocates, even after election results have been declared.

Advocate Mohandoss has clarified that he fully supports 30% reservation for women advocates as directed by the Hon’ble Supreme Court. However, he has objected to the retrospective implementation of the proposal after the completion of the election process.

The representation states that the Bar Council election in Tamil Nadu and Puducherry was conducted, contested, and concluded on the basis of 23 elected seats, and lakhs of advocates exercised their franchise on that notified strength. Any subsequent increase in the number of elected members, after declaration of results, would amount to changing the rules of the game after the election has concluded, contrary to settled principles of election law.

The representation also points out that the BCI communication itself is subject to examination by a Committee constituted by the Bar Council of India and to the final orders of the Hon’ble Supreme Court, and therefore no irreversible changes should be made to an election that has already concluded.

The representation further refers to discussions within the legal fraternity regarding the timing of the resolution following the Bar Council election results, in which the then Vice Chairman of the Bar Council of India, Senior Advocate S. Prabhakaran, was not elected within the notified strength. It states that these circumstances have raised apprehensions among advocates and urges that public confidence in the fairness and transparency of the electoral process be preserved. The representation requests that any concerns surrounding the issuance of the communication be examined by the competent authorities strictly in accordance with law, if considered necessary.

Advocate Mohandoss has urged the authorities to:

Maintain the election results already declared without alteration.

Reject retrospective implementation of the 21 July 2026 communication.

Apply any enhancement in elected strength only prospectively after statutory amendments and advance notification.

Await the final decision of the Hon’ble Supreme Court before altering the composition of the elected Bar Council.

He emphasized that democratic certainty, transparency, and the mandate of lakhs of advocates must be protected, and that any reform should operate only for future elections.
