In the SLP filed by Mr Durai Murugan and his wife Shanthakumari against the reversing order of discharge by the Madras High Court, the Supreme Court issued notice and granted a stay of proceedings.

The matter relates to the check period from 1st April 2007 to 31st March 2009. Earlier, the Special Judge, Vellore, had discharged them, holding that the charge is groundless, but the High Court set aside that order on the State’s revision, reviving the case and directing the trial court to proceed with the case. Aggrieved, they appealed to the Supreme Court. The Bench of Justice Dipankar Datta and Justice Augustine George Masih, after hearing arguments of Mr Mukil Rotagi for A1 and Mr P. Wilson Senior Advocates for A2, issued notice in SLP and stayed further proceedings in the Trial court, and directed that the matter be tagged along with similar cases pending before the Supreme Court on the issue of sanction.
