Heard Mr. Kapil Sibal, learned Senior Counsel appearing for the petitioner.

The counsel would first read this Court’s order dated 18.03.2024 to point out that liberty was given to the petitioner to make application before the Trial Court for deferment of the trial since this Court is in seisin of the matter. Thereafter the application was filed by the petitioner under Section 309 of the CrPC enclosing this Court’s order dated 18.03.2024 in the SLP (Criminal) No. 3690 of 2024. However, the learned Judge presiding over the Special Court, under his order dated 28.03.2024 declined to defer the Trial. The reason given for refusal is the direction by the High Court to conclude Trial on or before 31.07.2024.
3. As is clear, this Court is examining the merit of the High Court’s judgment dated 31.07.2024, in the present proceeding.
4. In the circumstances, we are of the view that the Trial ordered by the High Court should not proceed while this Court is considering the challenge by the accused. Accordingly, the proceedings in CC No.13 of 2019 pending before the Learned Additional Special Court is stayed, until the next date of hearing.
