THE HONOURABLE MR.JUSTICE V. LAKSHMINARAYANAN
WP No. 37168 of 2025
The Federation of Bus Operators Association of Tamil Nadu,
represented by its Secretary, 6, Bishop Wallers Avenue (East),
Chennai 600 004. .. Petitioner
v.
1. State of Tamil Nadurepresented by the Secretary
Home Department,
Fort Saint George, Chennai 600 009.
2. The Transport Commissioner,
Guindy, Chennai 600 032. … Respondents
PRAYER: This Writ Petition has been filed under Article 226 of the Constitution of India to issue a writ of Mandamus directing the respondents 1 and 2 herein to pass orders for revision of fares, in pursuance of the hearing of the stakeholders held on 05.03.2025 and representation received pursuant to the paper publication dated
30.05.2025.
For Petitioner : Mr.M.Palani
For Respondents : Mr.Haja Nazuruddin, AAG for Mr.M.Shajahan, SGP Mr.P.Hari Babu
ORDER
The petitioner is the Federation of Bus Operators Association
in the State of Tamil Nadu. This Association is a registered one existing for nearly 50 years. The petitioner had given a representation seeking enhancement of the bus fare. This is on account of the increase in the diesel fare, as well as several other factors, including the free bus passes that have been issued for certain category of persons in the State of Tamil Nadu.
2. The grievance of the petitioner is that, despite the meeting of stakeholders that was held on 05.03.2025, and the publication was effected on 30.05.2025 calling for representations, no further steps have been taken. Hence the writ petition.
3. When the matter came for admission, I heard Mr.M.Palani, for the petitioner and Mr.M.Shajahan, learned Special Government Pleader for respondents. Mr.Shajahan took time to get instructions from the respondents.
4. Today, when the matter was called, Mr.Haja Naziruddin,
learned Additional Advocate General appears on behalf of Mr.Shajahan. He stated that as many as 950 representations have been received and hence, the same could not be concluded. This, in my view is neither here nor there. The Government has already suffered an order in W.P.Nos.27122 and 27127 of 2024 on 29.10.2024. Nearly a year has lapsed, yet, no substantial progress other than the first meeting in March, 2025 and the publication in May, 2025 has been made.
5. Mr.Haja Naziruddin, on instructions from the second
respondent states that the first meeting of the Committee will be held on 07.11.2025, and final orders will be passed by 30.12.2025. The statement made by the learned Additional Advocate General on behalf of the second respondent is received as undertaking given by the second respondent to this Court.
6. Recording the same, the writ petition stands disposed of. The second respondent shall pass orders before 30.12.2025. For reporting compliance, list the matter on 05.01.2026.
