The Writ Petition in W.P.No. 14643 of 2020 filed by
Dr. M. Syed Fahrudeen and Dr. G.Kumaravel, Assistant
Professors, Government Royapettah Hospital, Chennai,
to direct the State and Central Governments to notify
50% of vacancies for in-service candidates for admission
to Super Speciality DM/MCh. Courses in academic
session 2020-2021 in the Medical Institutions in the State
of Tamil Nadu.
G.Sankaran, Advocate appearing for Petitioners
referred to the orders of Constitutional Bench of Hon’ble
Supreme Court of India in the case of ‘Tamil Nadu
Medical Officers Association vs. UOI” dated 31.08.2020,
by which it is held that the State is having legislative
competence and authority to provide them a separate
source of entry for in-service candidates seeking
admission to PG Degree courses, in excise of powers
conferred under Entry 25 List-III; hence, the State of
Tamil Nadu is requested to revive the allotment of 50%
seats in P.G. Medical Courses / Super Speciality courses
for in-service candidates in order to enable Government
Doctors in Tamil Nadu to acquire higher qualification by
getting admission under in-service quota.
The learned Advocate General Thiru Vijay
Narayanan appeared for the State informed that a
decision will be taken by the State Government in this
regard at the earliest. The Director General of Health
Services, Government of India issued Circular dated
08.10.2020 postponing the On-line Counseling till further
orders.
On hearing of the matter, the Hon’ble Mr. Justice
N.Anand Venkatesh, posted the matter for hearing on
16.10.2020, requiring the State and Central Governments
to file reply in the above stated facts and circumstances.
