Original Application No.695 of 2026 has been filed to grant an interim injunction restraining the Respondent/Defendant, pending the disposal of the present suit, directly or indirectly by themselves, their concerns, partners, servants, employees, agents, dealers, distributors, and all persons claiming under them from using or causing to be used the Plaintiffs Artistic Work or any other artistic work identical or similar to the plaintiffs Artistic Work in relation to the Impugned Services or any services or in any manner from marketing or offering services, advertising or dealing in any services bearing the Plaintiffs Artistic Work or any other artistic work identical or similar to the Plaintiffs Artistic Work so as to infringe the Plaintiffs copyright subsisting in the Plaintiffs Artistic Work.
3. Heard Mr.P.V.Balasubramaniam, learned Senior Counsel for Mr.Thriyambak J.Kannan, learned counsel for the applicants in all these applications.
4. The applicants had been benefitted with the registration of a Trademark of the word ‘TVS’, which is used for various goods and services including “Two wheelers, three wheelers, motor oil, additives to motor fuel, industrial oil, printed materials and services relating thereto. The defendant had infringed the
said trademark, which is evidenced from the name of the
respondent’s/defendant’s establishment namely, ‘TVS Bar and Restaurant” which is visually and phonetically deceptively similar to that of the
applicants/plaintiffs.
5. In such view of the matter, there shall be an order of injunction as prayed for.
6. Notice to the respondent returnable in four weeks. Private Notice is also permitted through Speed Post with Acknowledgment Due. The applicant shall comply with Order XXXIX Rule 3 of CPC.
7. List the matter after four weeks.
