[02/07, 18:20] Kasi Ramalingam: In the light of the above circumstances, I hereby put you on notice of my above representation to direct the above-mentioned resigned 6 MLA’s are not at all genuine, as enshrined under law while resigning after cross voting in the floor test against the direction of the whip, to join the ruling political party with the hidden agenda to re contest in the same constituency under the political banner of TVK and consequently, the Bypoll of the 6 MLA seats arose and the said expense of the bypoll of vacant MLAs have to reimbursed by the above resigned 6 MLA’s and as such I requested your good office to direct the above MLA’s to reimburse the cost of the election declared vacant due to their unlawful resignation and further restrain them from recontesting for the MLA’s election in the ensuing Bypoll, till the reimbursement of the entire expenses of the respective constituency and further request you to forward my representation to concerned ministry of India to collect the reimbursement amount in the consolidated fund of India, enabling your good office to conduct fair and free election of the Bypoll, at cost and expense of the resigned 6 MLA’s.

Sir, I hereby inform you, in the interest of the general public, to consider my earnest representation within 30 days of the receipt of this letter of representation, in view of public urgency, failing which shall cause me to initiate appropriate Writ Proceedings against your good office under Article 32/226 of the Constitution of India at your cost.

This representation, together with its annexures and quantified schedule of by‑poll expenditure, was duly dispatched one week prior to the Hon’ble Election Commissioner of India, the six resigned MLAs concerned, the Union Ministry of Law & Justice, and the Hon’ble Speaker of the Tamil Nadu Legislative Assembly, in strict conformity with professional practice and as a responsible Senior Lawyer, thereby ensuring that all constitutional stakeholders were placed on notice contemporaneously.
