ORDER
The direction in W.P.No.27019 of 2015, dated 1.2.2022, is as follows:
“Consequently, the order of the 4th respondent in Pa.Lu.No.E2/17546/2006, dated 12.02.2007 and the order of the 5th respondent in R/CD/NMC/QA/A.P./2015, dated 16.04.2015, insofar as not approves the appointment of the petitioner with effect from 21.08.2000 to 25.07.2006, is concerned, stands quashed. Accordingly, there shall be a direction to the respondents 2 and 3 herein, to pass appropriate orders granting approval of the appointment of the petitioner as Lecturer in the Department of Physics in the 6th respondent / College, with effect from 20.06.2001 onwards, together with all service and other monetary benefits. The respondents 2 and 3 shall endeavour to pass such orders, within a period of four weeks. Accordingly, the Writ Petition stands allowed. No costs. Consequently, connected miscellaneous petitions are closed.”
Claiming disobedience of the said order, present contempt petition has been filed.
2.On 16.12.2024, the Government pleader had taken notice and thereafter the contempt petition was listed on 27.01.2023, 12.01.2024, 25.10.2024, 21.02.2025, 04.04.2025, 27.06.2025, 25.07.2025 and 29.08.2025. On 29.08.2025, statutory notice was issued to the 2nd respondent. In spite of having received the statutory notice, the 2nd respondent / Director of College Education is not present before this Court.
3.It is rather unfortunate that the direction given in the Writ Petition was way back on
01.02.2022, and four weeks time was granted therein for compliance. In spite of the same, more than 3 1/2 years have lapsed and the 2nd respondent / contemnor is yet to comply with the said order. Thus, the disobedience claimed in the contempt petition is wilful in nature. So also the non appearance of the 2nd respondent / contemnor before this Court pursuant to the receipt of the statutory notice.
4.Hence, issue a Bailable Warrant to secure the physical presence of the 2nd respondent / contemnor / Director of Collegiate Education, Chennai before this Court. In the next hearing date viz. 21.11.2025, the 2nd respondent / contemnor shall submit his response as to why he should not be punished for wilful disobedience of the order of this Court.
5.Call on 21.11.2025. Registry shall mark a copy of this order to the Commissioner of Police, Greater Chennai, who shall depute a responsible police officer for execution of
the Bailable Warrant.
