The Supreme Court on Monday refused a plea seeking an urgent hearing over IndiGo crisis after the airline faced massive disruptions across the country, leading to the cancellation of thousands of flights for a week.

Chief Justice of India Surya Kant said it will first see what action is forthcoming from the government. Notably, more than 4,500 IndiGo flights have been cancelled since Tuesday last week.

“We can’t run an airline,” the court said while declining an urgent hearing on the plea over IndiGo crisis.

The issue was mentioned by a lawyer who told the Bench that passengers were suffering as flights were being cancelled without any prior intimation.

Chief Justice of India Surya Kant responded that while the situation was serious and “lakhs of people are stranded at airports,” the Court cannot not run an airline. The CJI noted that the Government of India has already taken cognisance of the crisis and added that “timely action appears to have been taken.”

“We can’t run an airline. It’s a very serious issue. We understand that. Lakhs of people have been stranded at the airport, people who have urgent work, who need to take care of health issues. But then the government of India has taken cognisance. Timely action appears to have been taken. Let us see what happens,” CJI Kant said.

Meanwhile, the Delhi High Court agreed to hear a Public Interest Litigation (PIL) on Wednesday which has alleged unchecked violations of rules by IndiGo Airlines, including arbitrary cancellations, overbooking, passenger rights violations, discriminatory practices, and DGCA compliance failures that led to the ongoing aviation crisis.

The PIL was mentioned before the Delhi High Court on Monday. The plea seeks an independent judicial investigation into IndiGo’s large-scale flight cancellations and directions to the Centre to provide basic facilities to the passengers stuck at various airports across the country immediately.

IndiGo’s operational disruptions continued for the seventh straight day on Monday, when 450 flights were cancelled. Since Tuesday last week, the largest airline in the country has cancelled more than 4,500 flights, leaving passengers stranded at airports.

The Director General of Civil Aviation (DGCA) had issued show cause notices to IndiGo CEO Pieter Elbers and the company’s accountable manager to explain the large-scale disruptions across the country.

On Monday, the airline responded to the Centre in a “highly-guarded” letter, sources told India Today.
