Supreme court directed the State of Chhatisgarh to file a report about reason for over detention of a convict and other similar prisoners to punish the State. After hearing A.Sirajudeen, senior advocate, the Supreme Court observed that the State has to be punished for such over detention and directed the State Government to file a report in this regard and also other cases of over detention and adjourned the case by four weeks.

Here, the Petitioner, who is the second wife of a deceased TNEB employee has sought disbursement of family pension to her. The first wife of the deceased is none other than the Petitioner’s sister. The Petitioner’s marriage with the deceased took place during the subsistence of the first marriage. Unfortunately, after the death of the first wife, the deceased employee could not register the name of the Petitioner as his nominee. Hence, the Petitioner is before this Court.
