- We should have ordered restoration of possession to the petitioner. Since the area encroached is land belonging to the Highways, we do not resort to restoration. We direct the Government to pay a compensation of Rs.5,00,000/- to the petitioner within a period of eight (8) weeks from the date of receipt of a copy of this order. The Government may recover the said compensation from the officers who are responsible for carrying out the erroneous eviction drive by taking law into their own hands without following the procedure contemplated under the Act. 10.
