(Order of the Court was made by the Hon’ble Chief Justice)
The matter is of some importance as it pertains to a
constitutional amendment of some vintage and the petitioner says that
the deletion of “Education” from the Second List and its inclusion in the
Third List in the Seventh Schedule to the Constitution goes against the
basic structure of federalism that the Constitution espouses.
2. The State should also be heard on the issue and the State of
Tamil Nadu through the Secretary in the Department of Education is
impleaded as an added respondent. The necessary amendment should
be carried out by the petitioner in the presence of an officer of this
court.
3. Learned Additional Solicitor-General takes notice on behalf of
the Union. Mr.P.Muthukumar, learned State Government Pleader,
takes notice on behalf of the State.
