- Previous story Item no 30, before Hon’ble Justice Asha Section 34 application was filed challenging an award. Based on the same award an execution proceeding was initiated before Kanchipuram Distrixt Court which was subsequently stayed by the High Court. Upon verification and contradictions with the Award copy, the Arbitrator was directed to be present before the Court. Also notice was issued by Justice Asha to the Bar council of Tamil Nadu directing them to verify enrolment details of the Arbitrator who passed out in 2013z The Arbitrator was present before the Court today and stated that this is a fraudulently obtained award and that he did not appear as a arbitrator at any point of time. The Hon’ble judge directed the Arbitrator to file an affidavit and the matter is posted to 9.01.20. Petitioner counsel- S.Sivaraman

Therefore, appointment of Special Officer to work one day in a week would be in-sufficient to deal with the affairs of ‘Kalaimaghal Sabha.’ That apart, the Special Officer has to give evidences before the Civil Courts, where suits are pending for recovery of money, property etc., wherein several crores of rupees are involved.
- Justice Senthilkumar Ramamoorthy noted that on verifying the challenged order it is proved that the respondent regarded the timely payment of the applicant of the due amounts for the variance between the GSTR 1 and 3B dated January 9, 2023. Even after the consideration the respondent incorrectly mentioned on Page 23 of the transcript that levied entity loses to settle tax liabilities within 15 days of obtaining the notice on 17th March 2023. The same claim opposes the documented proof.
