The Karnataka High Court has sought response from the State Government, on a plea filed by a former aide of absconding accused Swamy Nithyananda @ Rajashekaran Nithyananda Dhyanapeeta, wanting to transfer the alleged rape case being heard by a court in Ramanagara to any court in Bengaluru.

The petition filed by Lenin Karuppan in his plea has raised apprehensions that a fair trial cannot be had before the Additional District & Sessions Court, Ramanagara court. His main grievance is that vide order dated 18.09.19, the trial court recorded, de novo, the testimony of the petitioner, despite extensive examination in chief on two earlier occasions.

Nityananda was booked in 2010 for allegedly raping his former disciple. He and other accused are charged under section 376, 377, 420, 506, 120 B Indian Penal Code. The plea seeks to direct the trial proceedings to be continued thereafter by recording further evidence/examination-in-chief in continuation of evidence recorded on 08.08.2018 and 16.08.2018. After transfer of the trial proceedings to the Sessions Court in Bangalore.

Justice G Narendra will be further hearing the petition on December 12.
