Key points of the modified SOP

The order, issued in conjunction with Justice Satish Chandra Sharma, amends an SOP from February 2024. The modifications include establishing an empowered committee at the district level to oversee the process. This committee will consist of a nominee from the District Collector or District Magistrate, the Secretary of the District Legal Services Authority (DLSA), the Superintendent of Police, the prison Superintendent, and the Judge in-charge of the prison, with the DLSA Secretary acting as the convenor.

The revised SOP outlines a timeline for informing the DLSA Secretary if a poor undertrial prisoner is not released within seven days of being granted bail. The DLSA Secretary will then verify the prisoner’s available funds. If funds are insufficient, the District Level Empowered Committee (DLEC) will direct the release of funds for surety within five days of the DLSA’s recommendation. The DLEC is required to meet twice a month to review cases recommended by the DLSA. Additionally, for cases under the “Support to Poor Prisoners” scheme, the committee can authorize the provision of up to ₹50,000 per prisoner to the court through a fixed deposit or other approved method.
