ORDER
This writ petition has been filed to Call for the records relating to the impugned order of Rustication dated 25.05.2025 in RIGNIYD/ Admin/ 20252026/ 058 passed by the 1st respondent and quash the same and consequently permit petitioner to complete petitioners course by attending the exams and internship.
2. The learned counsel for the petitioner submits that the petitioner is the final year student pursuing second year master’s degree in Masters of Social Works in the college of first respondent and have cleared all his exams with no arrears and has discharged his duties as student to his utmost sincere and commitment. On 24.05.2025, the 6th respondent, visited hostel premises with warden and assistant warden alleged that he found some graffiti painted on the hostel wall by displaying ”Jai Bhim and Free Palestine”. Thereafter, the first respondent constituted an enquiry committee in which third respondent was appointed as chairperson. Further, the respondents 2 to 7 were also part of the enquiry committee. The sixth respondent influenced the enquiry committee and was breeding malafide against the petitioner and other students for exposing his pending sexual assault case against him in Jharkand. Summon was sent to the petitioner to attend enquiry at 4 p.m. on 25.05.2025 through Whatsapp around 2.45 p.m.,. In the enquiry, all of the delinquent students were forced to confess against the students who are responsible for the protest held on 04.04.2025. Further, the officer did not intimate the charges levelled against the petitioner and blatantly refused to give the opportunity to file the petitioner’s reply and did not consider the petitioner’s documentary evidences and conducted enquiry in an arbitrary and illegal manner. Further, the allegation levelled against the petitioner are based on the surmises and conjectures. Further, the petitioner sent a mail to the first respondent requesting to permit them to attend the examinations but no action was taken by the first respondent. Further, the petitioner was rusticated from the college without intimating the specific charges against the petitioner by accusing him for involving in anti national activity which is illegal and violation of right to dignity guaranteed under Article 21 of Indian Constitution. Further, the petitioner is IInd year student. if he is not permitted to attend internship programme it put too much hardship and irreparable loss to the petitioner. Further, sexual assault case is pending against the sixth respondent, which was exposed by the petitioner and other students due to which, the sixth respondent colluded with hostel warden harrased the petitioner in the above way. Hence, he prays to quash the order of rustication dated 25.05.2025 in RIGNIYD/Admin/2025-2026/058 passed by the first respondent.
3. Considering the welfare of the student/petitioner, the petitioner is at fagend of his carrier. If he is not permitted to attend the examination and internship programme it will cause too much hardship to the petitioner. Hence, the impugned order passed by the first respondent dated 25.05.2025 in RIGNIYD/Admin/2025-2026/058 is ordered to be stayed. Further, the respondent is directed to reschedule the examination for the petitioner and issue hall ticket to him so as to attend the examination and also permit him to attend block placement programme in social service department and also directed to include him in the whatsapp group for the purpose of continuing his education subject to the outcome of the writ petition.
4. Issue notice to the respondents returnable by 25.06.2025. Private notice is also permitted. Post the matter on 25.06.2025.
