The Government constituted Committee headed by retired Judge Hon’ble Mr.Justice A.Selvam as per G.O.Ms.No.536 dated 15.11.2018 consequent to High Court order passed in W.A.No.1051 of 2018 etc., cases dated 17.05.2018 for the purpose of categorization of Doctors employed in Remote/ Difficult/ Rural areas for awarding incentive/weightage marks for admission to P.G Medical courses. The Committee, while submitting report for categorization of Remote/Difficult/ Rural areas for awarding weightage marks also recommended to consider the issue of awarding marks on the basis of nature of work involving Critical Life Saving interventions demanding 24 hours duties like NICU, CEmONC, Trauma, Casuality in addition to area based incentives in consultation with Medical Council of India.
The Petitioner working as Senior Resident in Liver Transplant/ Cadaver Maintenance Unit in Government Stanley Medical College involving 24 hours duty to manage the critically ill patients with constant vigilance, utmost care, commitment and high degree of clinical acumen which requires Critical Life Saving interventions demanding 24 hours duties, entitled to be granted with incentive/weightage marks for the services rendered, for admission to P.G Medical course. Therefore, he filed the Writ Petition for the relief as prayed for.
The Hon’ble Mr.Justice M.Sundar, after hearing the matter at length through Video Conference on 22.04.2020 and on hearing the Counsels for State Government, Government of India, MCI and Selection Committee, was pleased to direct the Respondent State Government to consider the claim of the Petitioner on or before 18.05.2020 in consultation with MCI and Selection Committee and to communicate the same to the Petitioner and further any decision for publication of merit list is directed to be kept in abeyance till 08.06.2020. Therefore, the publication of merit list for admission to P.G Medical course is directed to be kept in abeyance till 08.06.2020.
