[12/12, 17:31] Sekarreporter: Mr. Masilamani says, GRSJ has granted relief to the writ petitioner beyond the pleadings made by the latter. He says, without pleadings, no litigation can travel in the right course and such a practice cannot be allowed.
[12/12, 17:31] Sekarreporter: Mr. Masilamani says he has great respect for GRSJ who is one of the finest judges of the court but he insists that for every fact that the judge had relied upon in his verdict, there should have been a corresponding pleading by the petitioner.
[12/12, 17:31] Sekarreporter: Mr. Masilamani says, the temple management need not prove that the stone pillar in question is not a Deepathoon but it is for the writ petitioner to prove that it is indeed a Deepathoon. I need not prove the negative, they have to prove the positive.
[12/12, 17:31] Sekarreporter: Mr. Masilamani says, the finding that the Deepathoon is on the hilltop is wrong. Only the dargah is on the hilltop. There are only two peaks on Tirupparankundram hills. On the highest peak is the dargah and on the second peak is the Uchipillayar temple, he adds.
[12/12, 17:32] Sekarreporter: Mr. Masilamani says, the stone pillar only appears to be a survey pillar and not a Deepathoon. He again reiterates that it is for the writ petitioner to prove that it is a Deepathoon.
[12/12, 17:32] Sekarreporter: Mr. Masilamani points out that the Subramaniaswamy Temple is not below the taller peak in the Tirupparankundram hills. He says, the temple is located below the smaller peak.
[12/12, 17:32] Sekarreporter: Mr. Masilamani gives a list of cases decided since 1912 regarding Tirupparankundram hill
[12/12, 17:34] Sekarreporter: Mr. Masilamani says, GRSJ ought to have referred the issue to a larger Bench since a Division Bench of Justices K. Kalayanasundaram and V. Bhavani Subbaroyan had already given a binding ruling. A single judge cannot suo motu revisit a settled issue, he says.
[12/12, 17:34] Sekarreporter: Mr. Masilamani says, a lamp cannot be lit on the Deepathoon since it is at the highest peak and is subject to vagaries of wind. Only a Deepam (a much bigger fire) would have to be lit by burning cloth. It may not be possible on such a small stone pillar, he says.
[12/12, 17:34] Sekarreporter: Mr. Masilamani asserts that Karthigai Deepam was never lit on the so called Deepathoon. Concludes his arguments.
