Prayer in Cont P(MD)No.3594 of 2025 : Contempt Petition filed under Section 11 of the Contempt of Courts Act, 1971 to punish upon the Contemnors/Respondents 1, 2 and 4 for the willful disobedience of the order passed by this Honourable Court in WP(MD) No.32317 of 2025 dated 01.12.2025 according to law.
Prayer in Cont P(MD)No.3657 of 2025 : Contempt Petition filed under Section 11 of the Contempt of Courts Act, 1971 to initiate contempt proceedings against the contemnors/respondents and punish him for the wilful disobedience of the order of the High Court in WP(MD)No.33197 of 2025 dated 01.12.2025.
COMMON ORDER
The Chief Secretary has filed an affidavit pursuant to the direction
given by this Court on the earlier occasion. It is taken on record.
2. Shri. K.J.Praveenkumar IAS, District Collector, Madurai,
Shri.J.Loganathan IPS, Commissioner of Police, Madurai City and
Shri.Yagna Narayanan, Executive Officer, Arulmigu Subramania Swamy
Temple, Thirupparankundram, Madurai and Shri.A.G.Inigo Divyan, DCP (South), Madurai City, the contemnors, are present in person.
3. The contempt petitions were listed on more than one occasion in the first week of December, 2025. It was again listed on 17.12.2025. Even though the contemnors had sufficient opportunity, they have not shown cause till date as to why contempt proceedings should not be initiated against them. The learned Additional Advocate General informs the Court that LPAs have been filed against the contempt proceedings and that they are yet to be taken up by the Hon’ble Division Bench. He prays for further time.
4. This Court vide order dated 01.12.2025 allowed W.P.(MD)No.
32317 of 2025 etc. batch for lighting the Karthigai Deepam atop the Thirupparankundram hill at the Deepathoon. This order was not obeyed by the temple authorities. To frustrate the judicial order, Thiru.Praveen Kumar, IAS, passed prohibitory order under Section 163 of BNSS, 2023.
Even though this prohibitory order was quashed by this Court, Thiru.Inigo Divyan, Deputy Commissioner of Police obstructed the implementation of the order of this Court. Unless proper cause is
shown, charges will be framed against the contemnors on 02.02.2026.
5. The primary order passed by this Court was upheld by the Hon’ble Division Bench in W.A.(MD)No.3188 of 2025 etc. batch on
06.01.2026. The Hon’ble Division Bench was pleased to declare that the Deepathoon area that is on the lower peak of the hill belongs to the temple. But in connection with the Sandhanakoodu festival, the Dargha authorities tied the flag of the Pallivasal in the tree in the Deepathoon area. Thiru.Yagna Narayanan, the Executive Officer states that the permission of the temple authorities was not obtained before doing so.
He concedes that what was committed by the Dargha officials was a rank criminal trespass. Since the property of the temple was
unauthorisedly trespassed upon by the Dargha officials, he stated that he would lodge a complaint immediately before the jurisdictional police. He undertook to comply with all the necessary formalities to launch a proper criminal prosecution in this regard. This statement was made in
the presence of the counsel Thiru.Chandrasekar.
6. The District Magistrate as well as the Deputy
Commissioner of Police informed the Court that they acted entirely on their own and not under dictation. Call on 02.02.2026.
