HCP filed by mother of Nalini (Life convicts prisoners in Ex Prime Minister Rajiv Gandhi video call case orders reserved

: Today 19.08.2020, HCP filed by mother of Nalini (Life convicts prisoners in Ex Prime Minister Rajiv Gandhi assasination case) was listed as item no.32 before the hon’ble bench consisting of His lordship Mr Justice Kirubakaran and Her Lordship Mrs.Velumani. Prayer sought in the HCP was that seeking permission of the court for Sri Murugan and Nalini to make video from the prison to UK where the mother of murugan is residing and to Sri Lankan where sister of Murugan is residing. Mr.A.Natarajan State Public Prosecutor represented on behalf of the state government. Mr.Radhakrishnan counsel for petitioner argued their fundamental right is getting affected and court must protect their fundamental rights. For which State PP informed the court that this is not fundamental or vested right and more over the fundamental right is not sky high. State PP also informed the court that GO Ms.No.524 of 2016 itself clearly explains the vested rights upon all prisoners that too only indian prisoner. State PP stated that no law or prison rule in india has given rights to foreign prisoner to make video call to foreign countries. State PP vehemently opposed regarding the prayer in the petition seeking to make video call daily 10 mins which is not possible and cannot be permitted. State PP also informed that already Murugan had made video call 4 times within india but only issue now is that they are seeking video call to foreign countries which falls under the boundary of Ministry of External affiars. Mr.Karthikeyan ASG appeared for the central government had informed that their counter by itself is clear and it may be recorded. After hearing the arguments of all the side the Hon’ble division bench had reserved the case for orders.
