(Order of the Court was made by the Hon’ble Chief Justice)
This Public Interest Litigation has been filed by the petitioner seeking to espouse a pubic cause of serious allegation that High Tension Electricity Transmission lines are crossing over the petrol pump outlet of respondent No.9.
2. Taking into consideration the allegation, the respondents were noticed.
3. From the affidavits which have been filed and various survey reports conducted by more than one authorities, it is more than clear that the allegation, is completely incorrect.
4. In fact, after having gone through the entire petition, we find no material to support any such allegation except certain photographs which can be hardly treated as proof of such
allegation.
5. It has been consistently held and time and again cautioned that before filing Public Interest Litigation, proper research is required to be carried out.
6. The petitioner without any factual foundation, made wild allegations which has resulted in harassment of respondents and various authorities and at the same time, it has wasted the time of the Court.
7. The Public Interest Litigation is completely frivolous and dismissed with cost of Rs.1,00,000/- [Rupees One Lakh only] payable to the Union Territory of Puducherry Legal Services Authority within a period of one month. Consequently, the connected Miscellaneous Petition is closed.
