On finding that a contempt petition pending on the file of the court from 2012 owing to non-service of a notice on one Kamakshidasan, the Madras High Court has directed the Deputy Commissioner of Police, Adyar and the Deputy Commissioner of Police, Mylapore to trace the whereabouts of the person and serve notice on him.
During the hearing, Kamakshidasan gave an undertaking which was recorded in an order dated March 17, 2009, that he will not sell the flat at Baktavatsalam Salai in Mylapore, till the disposal of the proceedings initiated against him by his wife in 2008. But after giving the undertaking he allegedly sold the property on April 4, 2012, for Rs 1.37 crore and thereafter became scarce. Alleging violation of the said undertaking, Sripriya filed the present contempt petition in 2012.
Justice PN Prakash, before whom the plea came, on recording the submission of petitioner’s counsel that Kamakshidasan’s whereabouts are now known to anyone and he is not appearing even in the trial court, said: “A perusal of the records of this court show that Kamakshidasan was earlier residing in Mandaveli and later shifted to Tiruvanmiyur. Notice sent to that address also returns unserved.”
“Therefore, this court directs the Deputy Commissioner of Police, Adyar and the Deputy Commissioner of Police, Mylapore to trace the whereabouts of Kamakshidasan, serve notice on him in this case, by serving a copy of this order on him and file a report before this court on or before January 20,” Justice Prakash added.
