Writ Petition in W.P.No.7543 of 2020 has been filed by Dr.G.P.Arulraj and others, Government Doctors, challenging the order of State Government judge v Parthiban order notice
In this regard, a Committee was constituted by State Government in G.O.Ms.No.536 Health and Family Welfare Department dated 15.11.2018 (consequent to High Court order) headed by Hon’ble Mr.Justice A.Selvam (Retd.). The Committee submitted report with recommendations to consider granting incentive marks for the doctors serving in Critical Care Life Saving interventions demanding 24 hours duty for admission to P.G medical courses under State Quota. The Government has also accepted the report and forwarded a letter to Government of India by stating that the work pressure for the Medical Officers working in NICU, CEmONC, Trauma and Casualty is more than the other fields and they acquire more practical knowledge in medical field, apart from theoretical knowledge with continuous exposures to the emergency situations and it is required to award incentive marks for the Medical Officers involving Critical Care Life Saving interventions demanding 24 hours duty.
Whereas, presently the order is passed by State Government, Health and Family Welfare Department on 24.04.2020 rejecting the claim by merely referring to the comments passed by MCI. Whereas the State Government is competent authority to take decision as per MCI Regulations and an independent decision to be taken based on the recommendations of the Committee.
When the Writ Petition came up for hearing today (29.04.2020) through Video Conference, the Hon’ble Mr.Justice V.Parthiban, after hearing the arguments on all sides, was pleased to direct the Respondents to file counter affidavit within a week’s time on 06.05.2020 and posted the matter for hearing for disposal on 08.05.2020.
