தேமுதிக தலைவர் விஜயகாந்த் அண்மையில் சிகிச்சைக்காக துபாய் சென்றுள்ளார்.. இந்நிலையில் அவருக்கு உடனிருந்து உதவி செய்ய பிரேமலதாவும் துபாய் செல்ல உள்ளார் .இந்த நிலையில் பிரேமலதாவின் பாஸ்போர்ட்டை புதுப்பிக்கப்பட்டிருந்தும் அவர் மீது திருநெல்வேலி காவல் துறையால் 2017 ம் ஆண்டு தொடப்பட்ட குற்றவழக்கு மறைக்கப்பட்டிருக்கிறது எனக்கூறி பாஸ்போர்ட் அதிகாரி அந்த பாஸ்போர்ட்டை சரண்டர் செய்யுமாறு உத்தரவிட்டு, திரும்ப பெற்றுக்கொண்டார் …இதை எதிர்த்து பிரேமலதா சார்பில் சென்னை உயர்நீதிமன்றத்தில் அவசர வழக்கு தொடரப்பட்டது. இந்த வழக்கு சென்னை உயர்நீதிமன்ற நீதிபதி மகாதேவன் முன்பு நடைபெற்றது. பிரேமலதா சார்பில் மூத்த வழக்கறிஞர் பி. வில்சன் ஆஜராகி, திருநல்வேலி காவல்துறையால் தொடரப்பட்ட குற்ற வழக்கு தொடர்பாக நீதிமன்றத்தில் இருந்து எந்த ஒரு சம்மனும் வரவில்லை என்றும், வழக்கு தொடர்பாக எந்த தகவலையும், மறைக்க வில்லை என்று தெரிவித்திருந்தார். தனது கணவர் விஜயகாந்தின் சிகிச்சையின் போது உடனிருந்துஉதவ வேண்டி உள்ளதாகவும் குறிப்பிட்டார். எனவே பாஸ்போர்டை திரும்ப தருமாறு கேட்டுக் கொண்டிருந்தார்..வழக்கு விசாரணைக்கு ஒத்துழைப்பு தருவதாகவும், எங்கும் தப்பி ஓட மாட்டோம் என்றும் அவரது தரப்பில் தெரிவிக்கப்பட்டது.. இதை ஏற்றுக்கொண்ட நீதிபதி மகாதேவன், பிரேமலதாவின் பாஸ்போர்டை உடனடியாக திரும்ப வழங்குமாறு மண்டல பாஸ்போர்ட் அதிகாரிக்கு உத்தரவிட்டார்.. அதேவேளையில் வழக்கு விசாரணைக்கு ஒத்துழைப்பு தருவோம், வெளிநாடு சென்று வரும் தேதியை பாஸ்போர்ட் அதிகாரியிடம் தெரிவிப்போம், எங்கும் தப்பி ஓட மாட்டோம் என்ற உறுதிமொழியை பாஸ்போர்ட் அதிகாரி இடம் வழங்குமாறு உத்தரவிட்டு, வழக்கு விசாரணை நான்கு வாரத்திற்கு ஒத்தி வைத்துள்ளார்..

Challenging the communication dated 26.08.2021 issued by the first
respondent, the petitioner has come up with this writ petition. A
consequential direction has also been sought to the respondent to reissue
the petitioner’s passport and permit her to travel abroad without insisting of
the no objection certificate from the court concerned.
2.The case of the petitioner is that after despatching a new passport
bearing no.Z6160081, the petitioner was issued with a communication of
the first respondent dated 11.06.2021 calling upon her to submit her
explanation with respect to the adverse police verification report given
against her. Pursuant to the same, she furnished her detailed reply vide
email dated 29.06.2021. Following the same, she was directed to appear
for enquiry. However, due to some difficulties, the petitioner was unable to
appear for enquiry. In the mean while, the respondent issued a show cause
notice dated 24.08.2021, calling upon the petitioner as to why action
should not be taken to impound her passport bearing no.Z6160081 under
section 12(1)(b) of the Passport Act, 1967. Accordingly, the petitioner
