Today Hon’ble Justice Anand Venkatesh ordered the State Election commission to hold elections to the post of Chairman and Vice Chairman of Thandarampattu Panchayat Union council ,Tiruvannamalai District with in 4 weeks in the two Writ Petitions filed by DMK Ward members P. Murugesan and G Parlimala .

The elections to post of Chairman and Vice Chairman were postponed thrice by the state election commission on the premise of Law and order and that the ST community certificate of DMK candidate G Parilmala is challenged by her rival opponents Mrs Selvi and Mrs Latha (both elected ward members) belonging to AIADMK Party.
The said Selvi and Latha filed two writ petitions which also came up for hearing ,to conduct elections to the posts of Chairman and Vice Chairman after deciding the community certificate enquiry of DMK candidate G Parimala.

Mr P. Wilson Submitted that the Tmt G Parimala DMK ward member got elected as a 27th ward member which ward is reserved for ST. Her elections is not challenged by any one till today. Merely the opponent raises doubt on the genuineness of her
Community certificate after being duly elected, cannot be a reason to hold on the elections of Chairman and Vice Chairman indefinitely. The formation of Union Council didn’t take place on this untenable grounds raised by political opponents and thrice the elections were postponed on the ground of Law and order.
Mr wilson submitted that 28 ward members were elected to Thandarampattu Panchayat Union on 2.1.2020 and even after lapse of 1 year 9 months the elections are not conducted to the posts of Chairman and Vice Chairman on these flimsy reasons. He submitted that if certificate of G Parimala is found to be false by the committee before whom the enquiry is pending ,all consequences will follow ; but that cannot be a reason to keep the Panchayat Union Council without being formed by electing Chairman and Vice Chairman indefinitely and the concept of local government stands defeated .
Mr G SivaShanmugam appearing for State Election Commission submitted that earlier there were law and order problems and that community certificate of G Parimala was under challenge by rival political party and therefore elections to these posts cannot be held three times.
Rejecting the contentions of State Election commission and accepting arguments of P. Wilson, the Learned judge ordered to conduct and complete the elections to these two posts with in 4 weeks from today. The Learned Judge held that as long as community certificate is not set aside and holds good till date, State Election commission is not right in postponing the elections on that ground. He also rejected that Law and order be a reason to postpone elections and ordered conducting of elections to the posts of Chairman and Vice chairman with in 4 weeks from today.
The court also ordered video coverage of entire elections by State Election Commissioner if transparency is required and also to get police protection from District SP .
